About this file

This is a Nondiscrimination Policy exhibit for the Colorado Department of Human Services (CDHS) Office of Children, Aging, and Community Services (OCACS). The policy establishes nondiscrimination requirements for vendors, contractors, sub-recipients, and service providers receiving OCACS funding. The document defines key protected characteristics including race, color, ethnic group, national origin, age, religion, mental or physical disability, sex, sexual orientation, gender identity and expression, marital status, familial status, pregnancy, veteran status, and HIV status. All contractors and vendors must comply with applicable state nondiscrimination laws and the State of Colorado Purchase Order Terms and Conditions Section 28 while performing services under their agreements with OCACS.

The policy requires that all contractors, subcontractors, grantees, and vendors receiving funding assistance through OCACS perform their contractual obligations in a manner consistent with nondiscrimination standards. The definitions section clarifies specific terms including gender identity, gender expression, familial status, marital status, and sexual orientation to ensure uniform understanding and application throughout the contracting process. This exhibit serves as a binding compliance requirement for all parties involved in providing services or benefits to clients served through OCACS.

Exhibit D: OCACS Nondiscrimination Policy Page 1 of 1

In alignment with Colorado Department of Human Services’ (CDHS) mission, “Together, we empower Coloradans to thrive,” it is necessary to ensure the equal opportunity, civil rights, and safety of clients served through the Office of Children, Aging, and Community Services (OCACS) and that those that receive our funds support all of our clients.

Definitions Gender identity: An individual's innate sense of the individual's own gender, which may or may not correspond with the individual's sex assigned at birth.

Gender expression: An individual's way of reflecting and expressing the individual's gender to the outside world, typically demonstrated through appearance, dress, and behavior.

Familial status: Status that includes children under the age of 18 in the household.

Marital status (or civil status): Distinct options that describe a person's relationship with a significant other. A person's state of being single, married, separated, divorced, or widowed. A person's specified civil status might also be married if they are in a civil union or common-law marriage. The civil status of a person who is legally separated is married.

Sexual orientation: An inherent or immutable enduring emotional, romantic or sexual attraction to other people.

Sub-recipients: County departments of human/social services (county departments) and OCYF contractors, subcontractors, grantees, and vendors who receive funding assistance through OCYF in order to provide services or benefits to clients.

Vendor/Contractor agrees to act in a manner consistent with State of Colorado Purchase Order Terms and Conditions Section 28 (see https://osc.colorado.gov/spco/ccu/purchase-order-terms-conditions), all applicable nondiscrimination laws, as well as the State of Colorado Department of Human Services (“CDHS”) Office of Children, Aging, and Community Services ("OCACS") nondiscrimination terms set forth herein.

Vendor/Contractor agrees that in its performance of this agreement it shall not discriminate based on race, color, ethnic group, national origin, age, religion, mental or physical disability, sex, sexual orientation, gender identity and expression, marital status, familial status, pregnancy, veteran status, or HIV status (“protected characteristics”).
