About this file

This document is an Exhibit B - Questions and Answers for Request for Proposal (RFP) 220000002177 issued by the Michigan Department of Transportation (MDOT) for Precast Vault Restroom Buildings with Installation at Roadside Parks. The RFP seeks responses from vendors to furnish and install precast concrete vault restroom buildings at various roadside park locations throughout the state. The contract has a base term of 5 years with three 1-year renewal options, potentially an 8-year contract. MDOT estimates approximately 7 installs per year, but the exact number and locations are unknown. The RFP was amended to correct specifications related to the roof color and texture of the restroom buildings. Bonds will be required for the awarded contract(s), but a bid bond is not required to be submitted with the bid. MDOT will be responsible for demolition and disposal of existing restroom facilities. Pricing is requested on a regional basis, and MDOT may award multiple regional contracts.

Pricing for the restroom buildings is to be firm for a 365-day period, with potential adjustments allowed during the contract term. MDOT will post a Notice of Intent to Award prior to the contract being approved by the Administrative Board. If the number and cost of installations exceed the estimated contract value, a change order would be required. If MDOT and the contractor cannot agree on a price increase, MDOT may terminate the contract for convenience and either add the region(s) to an existing contract or rebid a new contract.

Q # Document Section or

Topic Bidder’s Question State’s Answer

1 Schedule B.1 Can bids be by region or must pricing be provided for all locations be submitted?

Bid pricing may be by region and bidder does not have to provide prices for regions it is not willing to service. Award by region may be considered and multiple awards may be possible.

Schedule A Section 2.1 Timeframes

Will each park go through the State’s approval process when it decides to purchase a building?

The purpose of establishing the contract(s) is to standardize restroom buildings and to expedite the approval process. Once the decision is made and funds are available, it should be a short time period for a Delivery Order to be generated to start a project at a park.

3 Permits Are local permits going to be required for these buildings at the sites?

The MDOT Region Office will be responsible for obtaining required permits.

4 General Are all building sites on State land? Yes

5 Permits Will building permits from LARA be required? Yes, LARA will approve the plans

6 Plans Will a State plan review be required Yes, LARA will review and approve all plans.

7 Plans Are drawings of the buildings or the precast vaults, including weights and information for placement, available?

Drawings and specifications may be found at the manufacturer’s website, www.cxtinc.com.

Permits Will local health department permits be required?

Yes, MDOT will acquire the permits http://www.cxtinc.com/

9 Permits Will any compaction testing be required? No

10 Prevailing Wage Will prevailing wages be required? No

11 Permits Will State Soil Erosion and Sedimentation Control permits be required (especially if near a lake or stream)?

Schedule A Section 2.1 Timeframes

The 90 calendar day completion date cannot be met; is this specification correct?

This specification is incorrect on the RFP and will be corrected through an amendment.

14 General Will an addendum be issued based on questions?

Yes

15 General How many installs per year?

MDOT estimates 7 installs per year;

however, this number is not firm.

16 Schedule B.1 If only 7 installs per year, why are 80 park locations listed?

Because the building sites are unknown, pricing provided for all parks will aid in budgeting for future install and will enable MDOT to order as needed without having to request price quotes.

17 General If award is by region, is there a possibility that multiple locations request building projects to go at the same time?

Although multiple installs within a region may be possible, vendor should not have expectation that this will occur.

18 General Can vendors see the list of locations that are priority for each year?

The list could potentially change

19 General What is the order of install?

MDOT does not have an expected order.

Install locations are random and will be requested as funding is available and based on location priority.

Standard Contract Term, Paragraph 1

Is this a 5-year contract?

The base term of the contract is 5 years.

There are three 1-year renewal options so an 8-year contract is possible.

Schedule A Section 4. Pricing

Are prices held for 5 years?

Per Schedule A, Section 4, prices are firm for a 365-day period and adjustments may be requested during the contract term

22 Award Will contracts be awarded per region?

MDOT is open to awarding multiple contracts and will be reviewing pricing per region.

23 General Is MDOT responsible for removing the old, existing buildings at the roadside parks?

Yes

26 Award When will vendors know the value of the awarded contracts for bonding purposes?

Will it be prior to Ad Board?

A Notice of Intent to Award (NIA1) will be posted on SIGMA VSS shortly after the evaluation is complete and award(s) determined. The NIA1 will be posted prior to Ad Board.

27 Bonds Is a bid bond required to be submitted with the bid? If so, what will be considered the contract value?

Bonds are not required with the bid.

Performance and Lien bond documents will be presented to the vendor(s) following contract award(s). The value of contract(s) will be indicated in the Award Recommendation and Synopsis which will be posted on the Notice of Intent to Award in SIGMA VSS.

28 General Does MDOT plan to do a change order every time another building is added?

The value of the awarded contracts will be estimated based on MDOT’s priority list and other factors. A change order will be necessary if the number and cost of installs exceed the estimated value of the contract.

29 General What are the options if MDOT does not agree with a contractor’s requested price increase?

If MDOT and the contractor cannot come to an agreement, MDOT may terminate the contract for convenience (per Standard Contract Terms, section 25). If the contract is terminated, MDOT may request the region(s) be added to existing contracts or may rebid a new contract.

30 General

How soon in each year will you know how many and what locations will be done? For locations in the U.P., lead time may not allow installation within the same year.

Typically in early spring MDOT has a good idea of the plan for projects.

31 General

For locations that have existing facilities is the assumption that these facilities are to be demolished and disposed of by the selected contractor and included in the price of installing the new facility

MDOT will be responsible for demolition, removal, and disposal of existing vault toilet buildings. Bidder’s price should not include these services.
