About this file

This Data Protection Addendum (DPA) is between the Board of Trustees of the Colorado School of Mines and an unnamed contractor, establishing comprehensive data privacy and security requirements for services related to the MINES25044 Prospective Student Communication contract. The addendum outlines detailed protocols for handling Mines' data, including definitions of confidential information, personally identifiable information (PII), and education records. It specifies the contractor's obligations for data use, protection, and destruction, with strict guidelines on accessing, storing, and transferring sensitive information related to students and employees.

The document mandates robust security measures, including annual SOC2 Type II audits, network security and privacy liability insurance with minimum coverage of $1,000,000 per occurrence and $2,000,000 aggregate, and compliance with numerous federal and state regulations such as HIPAA, FERPA, and the Colorado Open Records Act. The contractor must implement advanced security controls, perform background checks on employees, and maintain comprehensive safeguards against data breaches. The addendum also includes provisions for potential contract termination in case of security violations, indemnification requirements, and ongoing compliance monitoring, reflecting the high stakes of protecting educational institutional data.
