Justification for an Exception to Fair Opportunity

The initial procurement was competed among all eligible Service-Disabled Veteran Owned Small Business (SDVOSB) multiple-award Indefinite Delivery/Indefinite Quantity (IDIQ) contractors using FAR 16.505 procedures whereby Patriot, LLC was selected for this requirement. Patriot, LLC is the contractor best acquainted with the needs of the Department and is familiar with the current support services being provided. Having another contractor assume the current services, without adequate time for a comprehensive transition would create an administrative burden for the Department and the customers served, create a loss of service, and reduce operational capabilities. It is cost-effective, efficient, and timely to maintain the current support for no more than a year to allow the Department to refine requirements, conduct competition, and smoothly transition to a new vendor.

5. FAIR AND REASONABLE DETERMINATION

The Contracting Officer anticipates that the price will be fair and reasonable. The pricing established by the Government under the NITAAC CIO SP3 SDVOSB contract has already been declared fair and reasonable.

6. OTHER SUPPORTING FACTS
