About this file

This is a Fair Opportunity Exception justification document for a delivery order issued under FAR Part 16.5 procedures on a Department of Homeland Security (DHS) multiple award contract.

The Transportation Security Administration (TSA), Law Enforcement/Federal Air Marshal Service (LE/FAMS), and Counter Unmanned Aircraft Systems (C-UAS) Procurement program is issuing a sole source delivery order to Dedrone Defense LLC (owned by Axon Enterprise Inc.) for C-UAS fixed and mobile radio frequency (RF) based sensors and software to support field-based law enforcement response to unauthorized drone activity in controlled airspace at 15 Core 30 airports designated as Covered Facilities or Assets by the Secretary of Homeland Security. The order is valued at an estimated amount (redacted) with a one-year period of performance and will be issued under the DHS mandatory strategic sourcing C-UAS Indefinite Delivery Indefinite Quantity (IDIQ) vehicle. The Dedrone RF-560 Detect, Identify, Monitor, Track (DIMT) system is a U.S.-manufactured, advanced passive RF detection system designed as a direct replacement for existing Dedrone specialized systems already owned and operated by TSA and DHS. Market research identified 12 alternative vendors and systems but concluded that only the Dedrone RF-560 meets TSA/FAMS minimum system requirements due to its interoperability with existing Dedrone portal, graphical user interfaces, workflows, alerting processes, and training investments, combined with its ability to detect non-compliant and spoofed unmanned aircraft systems, decrypt encrypted telemetry, and independently geolocate operators. The fair opportunity exception is justified under FAR 16.507-6(b)(2) for supplies that are unique or highly specialized, with pricing determined as fair and reasonable against the DHS mandatory strategic sourcing C-UAS IDIQ baseline. Approval authority is required based on estimated procurement value exceeding $900,000.
