About this file

This document is a federal contract evaluation provision (FAR 52.212-2) for commercial products and commercial services, effective April 20, 2026.

The evaluation methodology establishes a best-value approach wherein the Government will award the contract to the responsible offeror with the technically acceptable quote at the lowest evaluated price. Offerors must accept all solicitation requirements, including technical requirements and terms and conditions, upon quote submission; non-conformance may render a quote non-awardable without further evaluation. The Government reserves the right to award to other than the lowest-priced quote if justified by higher quality. The two evaluation factors are as follows: Factor 1 – Price evaluates the offeror's quotation for cost-effectiveness to the Government; Factor 2 – Technical assesses whether the vendor's quoted item meets all requirements specified in Attachment 6 (Salient Characteristic), with quotes assigned a rating of either "Acceptable" (clearly meets minimum requirements) or "Unacceptable" (does not clearly meet minimum requirements). Technical submissions must be completed using a secondary document and provide clear, concise, and sufficiently detailed information to substantiate claims and demonstrate compliance with solicitation requirements. Offerors must assume the Government has no prior knowledge of their experience and will base evaluation solely on information presented in the offer.

As prescribed in 12.205(a)(2), insert a provision substantially as follows:

Evaluation—Commercial Products and Commercial Services (20 April 2026)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

Price Technical Acceptability

(End of provision)

ADDENDUM TO FAR 52.212-2:

Best value is expected to result from selection of the technically acceptable quote with the lowest evaluated price.

By submission of its quote, the vendor accepts all solicitation requirements, including all technical requirements and terms and conditions. Failure to conform to solicitation requirements may result in a quote being determined not awardable without further evaluation. The evaluation criteria are detailed below:

Factor 1 – Price. The Government will award a contract resulting from this solicitation to the responsible offeror whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government reserves the right to award to other than the low quote for a higher quality item.

Factor 2 – Technical. The purpose of the technical factor is to assess whether the vendor’s quoted item meets all of the provided information from the Salient characteristic Attachment. Each vendor’s quote will be evaluated against technical requirements and will be assigned a rating of “acceptable” or “unacceptable.” Technical submission must be completed using a secondary document. The Technical information shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims. Proposals shall provide convincing rationale addressing how the technical portion of the offer meets solicitation requirements. Offerors shall assume the Government has no prior knowledge of the offeror’s experience. The Government will base its evaluation on the information presented in the offer.

Rating Description:

“Acceptable” - Quote clearly meets the minimum requirements of the solicitation.

“Unacceptable” - Quote does not clearly meet the minimum requirements of the solicitation.

The quote will be determined technically acceptable if it meets the requirements set out in the Attachment 6 - Salient Characteristic.
