EVALUATION FACTORS

LITIGATION SKILLS TRAINING

I. Basis for Contract Award The Government intends to award a contract to the responsible quoter whose quotation is responsive to the solicitation and is determined to be the best value to the Government, using the tradeoff approach. Selection of the best value to the Government will be achieved through a process of evaluating the strengths and weaknesses of each quoter’s quotation against the evaluation criteria described below. In determining the best value to the Government, the Technical Capability and Past Performance Evaluation Criteria, when combined, are more important than the evaluated price. The Government is more concerned with obtaining a superior Technical Capability quotation than making an award at the lowest evaluated price. However, the Government will not make an award at a price premium it considers disproportionate to the benefits associated with the evaluated superiority of one technical and management quotation over another. Thus, to the extent that two quoters’ technical and past performance quotations are evaluated as equal, the evaluated price is more likely to be a determining factor.

II. Factors and Relative Importance Factor 1: Technical Capability Subfactors A. Contract Requirements

· Quotations will be evaluated on the quoter’s ability to provide all the contract requirements relating to Litigation Skills Training. These requirements include training participants in a manner that applies adult learning principles to engage and teach participants using different forms of learning mediums. Course materials shall be well organized and align with course agenda. Quoter must demonstrate a clear understanding of the requirements by describing the agenda, planned training, and elements therein as they relate to the Statement of Work (SOW), and quotations will be evaluated on the quality of services provided. Technical criteria include:

1) Relevant qualifications of proposed trainers, including high-level education, training, and experience with developing and conducting the full range of live, virtual litigation skills training (including but not limited to civil discovery and deposition skills, oral advocacy, and civil trial skills).

2) Quoters must address potential conflicts of interest. Quoters may not employ any person who is an employee of the US government if that employment would, or would appear to, cause a conflict of interest. Quoters must disclose any relevant facts or circumstances that could give rise to an organizational conflict of interest as defined in the FAR Subpart 9.5.

3) Quoters must address their ability to deliver accessible training to persons with disabilities and comply with the Americans with Disabilities Act and other applicable laws, rules and regulations governing accessibility. All audiovisual equipment and displays must be fully accessible to individuals with disabilities in compliance with the Americans with Disabilities Act, as amended.

B. Availability to Deliver Training Quoters will be evaluated on the ability of the quoter to provide the required services, within twelve months from the execution of the contract. No additional dates will be considered by the Government.

Factor 2: Past Performance A. Past Performance The quoter must provide a minimum of three (3) references for past performance for the same or similar services awarded within the past three (3) years. Contact information should include:

· Reference’s business name and address;

· Point of contact;

· Contact phone number and email address; and

· Services provided, contract type/number, and contract value.

Past performance will be evaluated based on the following criteria:

· Quoter provides the required number of references along with all requested contact information, contacts’ response concerning the quoter’s timeliness, responsiveness, and quality of service on similar requirements, and whether any customer service issues were addressed and resolved fully and quickly;

· Contacts’ level of satisfaction with the quoter’s product; and

· Whether the contact noted any problems, and if they did, the Quoter’s ability to resolve them immediately and effectively. A quoter without a record of relevant past performance or for whom information on past performance is not available; the quoter may not be evaluated favorably or unfavorably on past performance.

Factor 3: Price A. Price The price quotation will be evaluated against the Independent Government Cost Estimate (IGCE). The Quoter must provide a list of all labor, and other direct costs proposed for completion of the tasks described in this Statement of Work.
