About this file

This document is an addendum to a Request for Qualifications (RFQ) issued by the Texas General Land Office (GLO) for Pre-Positioned Residential Construction Repair Services related to Disaster Recovery and Mitigation Programs. The purpose of this RFQ is to contract with qualified providers to repair (reconstruct or rehabilitate) single-family housing as part of the GLO's long-term disaster recovery and mitigation programs funded through Community Development Block Grants for Disaster Recovery (CDBG-DR) and/or Mitigation (CDBG-MIT). The solicitation has a release date of March 11, 2024, with questions and answers due by April 10, 2024 at 2:00 PM CT. The GLO will consider responses from providers who may have been awarded a previous related contract in 2023.

The document addresses various clarifications and responses to questions, including provider responsibilities for estimating project costs, allowances for project delays, and insurance requirements. It also confirms that price adjustment requests will be considered by the GLO after the initial four-year term of any awarded work order. The contract is intended to cover residential construction repair services in multiple Texas jurisdictions, including Travis County and the City of Austin.

Q# Section # Text of Passage being questioned

Question GLO Response

1 General General Question

How does this solicitation differ from the solicitation issued and awarded in 2023

(RFQ NO. X0028075-

RS)?

The purpose of RFQ No.

1111-RS is to contract with qualified Providers to repair (reconstruct or rehabilitate) single-family housing as part of the GLO’s CDBG-DR and CDBG-MIT long-term disaster recovery/mitigation programs. The purpose of RFQ NO. X0028075-RS was to contract with qualified Providers to perform repair services necessary for potential future short-term disaster response programs (examples of similar past programs include PREPS and

DALHR).

2 General General Question

If a contractor was awarded RFQ NO.

X0028075-RS, are they allowed to also submit a proposal on this solicitation?

Yes.

3 General General Question

If 2023 year end financials are not yet completed, what should a prospective bidder

We can accept unaudited 09/30/2023 financial data.

Texas General Land Office -5- RFQ No. 1111-RS Addendum No. 1 provide for financial capabilities?

4 General General Question

In what instance would the resulting award from RFQ NO.

X0028075-RS be utilized and engaged in lieu of this new solicitation RFQ No.

1111-RS? Is there a differing factor between the two solicitations that would affect which one of these would be engaged in the event of a disaster requiring Residential Construction Repairs?

See answer provided for Question No. 1. The solicitations cover similar services for two different purposes and funding sources.

5 General Clarification

Who is responsible for estimating the project/projects?

The Provider is responsible for developing a detailed estimate for cost of repairs (ECR) for each project assigned. Separately, the GLO develops an ECR through a third-party vendor, which is compared to the Provider’s ECR for scope and cost reasonableness.

6 General General Question How are discrepancies in estimates addressed?

If the two ECRs are within 15% of each other, the Provider’s estimate is used for the project. If there is more than a 15% difference, the GLO has a process to determine the final estimate on a case-by-case basis.

7 General General

Can a chosen contractor decline a project/project?

No. Providers are expected to complete all projects assigned to them.

Texas General Land Office -6- RFQ No. 1111-RS Addendum No. 1

8 General Clarification

If significant reconstruction is required 120 Days from NP may not be enough time to complete a project. What lenience is there for projects that will go over 120 Days?

A 120-day construction period is standard for our programs and Providers are expected to complete construction within that allotted time. However, Providers are not held responsible for delays outside of their control (ex. weather, homeowner moveouts, utility delays, municipal delays, etc.). Such cases are considered on a case-by-case basis.

9 General Question

In the past 3 years what type of event in TX could we associate with GLO stepping in with assistance for residential customers?

The GLO is still actively rebuilding single-family housing damaged or destroyed by Hurricane Harvey, 2018 Flood Events, and 2019 Disasters. Providers awarded a contract under this solicitation may be used to support active grants or future events for which the GLO receives a grant allocation.

10 General Question

Will the primary customer not have insurance to cover said loss (low income properties)?

Because program requirements prohibit any duplication of benefits, the primary customer will not have insurance to cover their loss. Historically, per CDBG requirements, the majority of our beneficiaries are considered low-to-moderate income.
