About this file
This document is a Supplemental Form 1 - Waiver Request for the Texas Hydrogen Infrastructure, Vehicle, and Equipment Grant Program (THIVE) administered by the Texas Commission on Environmental Quality (TCEQ) under the Texas Emissions Reduction Plan (TERP). The THIVE program provides funding for projects that reduce nitrogen oxide (NOx) emissions in Texas nonattainment areas and affected counties, including Travis County and the City of Austin. This form allows applicants to request waivers for the ownership, registration, and usage requirements of the program if they can demonstrate good cause. Applicants must complete Part A to provide a detailed explanation of the good cause for the waiver request and confirm if the replaced vehicle/equipment will continue to operate in Texas without the grant. Applicants who plan to purchase third-party vehicles or equipment must also complete Part B, which requires certifications from the current owner regarding the vehicle/equipment's registration, operation, condition, and qualification under the program.
The document provides instructions on how to fill out the form and the criteria TCEQ will use to determine if good cause exists for granting a waiver request. Applicants must submit a separate Supplemental Form 1 for each activity that includes a waiver request, along with the Project Application Form, to be considered for the THIVE program funding.

If you have questions about how to fill out this supplemental form for a waiver request, please contact us at 512-239-4950 or TERP@tceq.texas.gov.
TCEQ may consider a request to waive one or more of the program requirements based on a finding of good cause.
• This may include short lapses in registration or operation due to economic conditions, seasonal work, or other circumstances.
• The burden is on the applicant to demonstrate why there is good cause to grant the waiver request.
Refer to Appendix B of the THIVE program Request for Grant Applications (RFGA) for TCEQ’s basis for determining good cause.
Applicants requesting a waiver to one or more of the program requirements must complete Part A of this form. Applicants who have purchased third-party vehicles or equipment, or who plan to purchase third-party vehicles or equipment from another entity for the purpose of replacing and disposing of those vehicles or equipment under the THIVE Grant Program, must complete Parts A and B of this form.
Please complete a separate Supplemental Form 1 for each activity that includes a request to waive one or more of the program requirements and submit the completed form with the Project Application Form (TCEQ-20976/a).
