Summary

This Request for Proposals (RFP) is issued by Workforce Solutions Borderplex, Inc. (WSB), a Texas workforce development board serving six counties in the El Paso region, soliciting contractors to provide economic development and workforce program services as a supplemental procurement to an original FY26002RFP award. The RFP seeks proposals for Lot 3: Economic Development Projects, which encompasses services to diverse populations including targeted unemployment insurance recipients, high school students, college students and stop-outs, childcare program families, youth participants, military personnel, veterans, and underemployed workers. Contractors will provide tailored services including skills assessments, job counseling, Individual Employment Plan development, job placement, subsidized work experience, skills training enrollment, case management, and supportive services. The RFP was released October 27, 2026, with a proposal deadline of December 2, 2026, at 3:00 p.m. Mountain Standard Time submitted exclusively through the Beacon Bid portal. A virtual proposal opening is scheduled for December 2, 2026, at 3:05 p.m. MST via Microsoft Teams. The contract term is anticipated to be 12 months with options to renew for up to four additional one-year periods, contingent on satisfactory performance, continued need, and funding availability, for a maximum total term of five years. Questions must be submitted by November 11, 2026, with answers posted by November 20, 2026.

Pricing and compensation are to be negotiated with conditionally qualified providers; contractors must submit detailed budget proposals based on allowable, reasonable, allocable, and necessary expenses without predetermined set-asides. Contractors will serve as subrecipients administering federal funds from WIOA Adult and Dislocated Worker programs, WIOA Youth, TANF/Choices, SNAP E&T, Non-Custodial Parent programs, and other government or privately funded sources. The RFP emphasizes performance-based contracting with contractors required to achieve 95 percent data integrity and compliance standards. Contractors must employ staff reflective of priority populations served, maintain a living wage minimum, and ensure at least 10 percent of staff reside in the El Paso region for in-person service delivery. Contractors must obtain commercial general liability insurance ($1,000,000 per occurrence/$2,000,000 aggregate), workers' compensation coverage, and professional liability insurance as specified. WSB reserves the right to modify contract terms, including funding levels, scope of work, and performance measures, with 30 days' written notice, and may terminate contracts based on performance, noncompliance, or insufficient funding. Only bidders not debarred or suspended from state or federal business may apply; small businesses and service-disabled veteran-owned businesses certified under the State of Texas VetHUB Program are encouraged to respond.

Workforce Innovation and Opportunity Act (WIOA) Overview

On July 22, 2014, President Obama signed into law the Workforce Innovation and Opportunity Act (WIOA).

WIOA is designed to improve and streamline access to federally funded employment, education, training, and support services. Every year, the key programs that form the pillars of WIOA help tens of millions of job seekers and workers to connect to good jobs and acquire the skills and credentials needed to obtain them. The enactment of WIOA has provided an opportunity for reforms to ensure the One-Stop Delivery System is job-driven, responding to the needs of employers and preparing workers for jobs that are available now and in the future.

WIOA has six main purposes:

Increase access to and opportunities for employment, education, training, and support services for individuals, particularly those with barriers to employment.

Support the alignment of workforce investment, education, and economic development systems in support of a comprehensive, accessible, and high-quality workforce development system.

Improve the quality and labor market relevance of workforce investment, education, and economic development efforts.

Promote improvement in the structure and delivery of services.

Increase the prosperity of workers and employers.

Provide workforce development activities that increase employment, retention, and earnings of participants and that increase postsecondary credential attainment and as a result improves the quality of the workforce, reduces welfare dependency, increases economic self-sufficiency, meets skills requirement of employers, and enhances productivity and competitiveness of the nation.

2.4 Cone of Silence

WSB's Cone of Silence was adopted to ensure a fair and competitive bidding environment by preventing communication between WSB officials, employees, or representatives and parties involved in the bidding process that could create an unfair advantage to any party regarding the award of a WSB contract.

The Cone of Silence period begins on the day the Request for Proposals (RFP) is advertised and continues through WSB’s notice of the applicable procurement decision for the proposal under review. For proposals submitted after the RFP is reopened, the Cone of Silence applies during the review, evaluation, and conditional qualification process for each submission. The Cone of Silence prohibits communication or lobbying activities during the applicable Cone of Silence period by any person, including but not limited to bidders, lobbyists or consultants of bidders, service providers, or potential vendors, and any of the following:

WSB Board members, WSB staff, and associated parties are precluded from entertaining any questions outside the bidders' conference and/or the written question process described below. Potential applicants are asked to respect these conditions by not making personal requests for assistance. Unauthorized methods or sources of responses or clarification are considered invalid. Any violation of this process may result in the disqualification of an applicant.

2.5 Inquiry and Protest Procedures

a) Debriefing

The purpose of a debriefing is to provide transparency in the procurement process and help bidders understand how their proposals were evaluated. Debriefings are intended to:

• Explain WSB's proposal evaluation system.

• Review how the bidder's proposal was scored or ranked.

• Offer constructive feedback to help improve future submissions.

During the debriefing, WSB staff and/or independent evaluators will meet with the requesting party to review:

1. The overall evaluation process.

2. The bidder's individual scoring and ranking.

Important Notes:

• Debriefings are not an opportunity to access confidential or proprietary information belonging to other bidders.

• WSB will provide as much information as legally permissible but must comply with restrictions on disclosure.

• Examples of restricted information include proprietary data and evaluation details of other proposals.

Debriefings serve as an educational tool for bidders, providing WSB with valuable feedback to improve future procurements.

i. Debriefing Requests Bidders seeking a debriefing must submit a written request within ten (10) business days of receiving WSB's notification of the procurement decision. The purpose of the debriefing is to provide information on the procurement process and explain how the bidder's proposal was evaluated and ranked.

WSB will acknowledge receipt of the request in writing within three (3) business days, confirming the date and time of the scheduled debriefing. Debriefings will be scheduled as promptly as possible and no later than ten (10) business days from the date WSB receives the written request.

b) Written Notice of Appeal

If, after the debriefing, the appealing party wishes to continue with the appeal process, they must submit a Written Notice of Appeal to WSB within ten (10) business days of the debriefing date.

The notice must clearly state that it is an appeal and include the following information:

• The solicitation being appealed (e.g., RFP number and date).

• The name, address, phone number, and fax number of the appealing party.

• The specific grounds for the appeal.

c) Informal Hearing An Informal Hearing will be held at WSB offices within ten (10) business days of WSB's receipt of the Notice of Appeal. The Hearing Officer, or a designated representative, will conduct the hearing and meet with the appealing party to review the specific concerns and grounds for appeal identified in the Notice of Appeal.

The Hearing Officer may recommend to WSB's Chief Executive Officer any appropriate actions permitted under the program's funding source rules and regulations, and consistent with WSB's Procurement Policies, to resolve the issue. If the appealing party agrees with the resolution, the appeal process will conclude at this stage.

d) Request for Formal Hearing If the appealing party is not satisfied with the outcome of the Informal Hearing, they must notify the Hearing Officer in writing within five (5) business days of the Informal Hearing date of their intent to proceed with a Formal Hearing.

The request must be submitted in writing and delivered to WSB in accordance with the same instructions for submitting a Notice of Appeal. Within ten (10) business days of receiving the request, WSB will provide written notice confirming the next steps.

e) Formal Hearing and Final Decision

The Formal Hearing will be conducted within fifteen (15) business days of WSB's receipt of the request. An Independent Hearing Examiner (IHE) will preside over the hearing, review all facts presented, and consider the grounds for appeal and requested remedies.

IHE may request additional information as needed. After a full review, the IHE will issue a written decision no later than sixty (60) days from the date of the original Notice of Appeal. The IHE's decision is final and concludes the appeal process at the local level.
