About this file

This is Amendment No. 1 to Bid No. IW267581 issued by the Texas Department of Criminal Justice (TDCJ), Contracts and Procurement Department. The amendment addresses four clarifying questions submitted by prospective bidders regarding air conditioning parts and accessories. The original bid opening was scheduled for October 15, 2026, at 3:00 PM. The solicitation requests various items including Trane manufacturer components and four 25-pound R-410A refrigerant cylinders. Bidders are required to acknowledge receipt of this amendment in their bid submissions, or their bids may not receive consideration. TDCJ confirms that partial shipments are acceptable and requests bidders to provide their best possible delivery date following purchase order issuance.

Key clarifications provided in the amendment address several bidder concerns. Regarding artificial intelligence use, TDCJ restricts vendors from utilizing AI systems in contract performance without prior written consent, though the amendment confirms this applies to post-award performance rather than pre-award bid preparation. TDCJ confirms that the receiving facility employs an EPA Section 608-certified technician, with documentation available as needed to satisfy refrigerant sales compliance requirements. All specified line items are manufactured by Trane except Item 7 (R-410A refrigerant), which may be supplied by any manufacturer; however, alternate manufacturers require submission of specification documents for TDCJ review and approval prior to award.

Question

Answer

1 The solicitation states that the vendor agrees not to use artificial intelligence in the performance of the contract without TDCJ's prior written consent. Please clarify whether this restriction applies only to post-award contract performance and fulfillment, or whether it also applies to pre-award administrative bid preparation, pricing calculations, and document formatting. If awarded, we will not use artificial intelligence in contract performance unless TDCJ provides prior written consent.

Artificial Intelligence Disclosure Respondent certifies that its Response discloses each artificial intelligence system it may use to complete any deliverable or a portion of any deliverable under the Contract.

“Artificial intelligence system” means a machine-based system that for explicit or implicit objectives infers from provided information a method to generate outputs, such as predictions, content, recommendations, or decisions, to influence a physical or virtual environment with varying levels of autonomy and adaptiveness after deployment. Respondent promises not to use an artificial intelligence system to perform the Contract without the prior written consent of the TDCJ.

2 For IW267581, please confirm: (1) the required delivery deadline in calendar days after purchase order issuance and whether partial shipments are permitted;

Delivery deadline needs to be your best possible delivery date.

We will accept partial shipments

3 For Item 7 (four 25-lb R-410A cylinders), whether TDCJ will provide documentation showing that the receiving facility employs an EPA Section 608-certified technician, as needed for a distributor/reseller to comply with refrigerant sales restrictions

Yes, the unit has a certified EPA technician, and documentation can be provided if needed.

4 Could you please verify the manufacturer names listed for all line items? I noticed that several manufacturer names do not appear to match the manufacturer part numbers provided. For example, the line item for R-410A Refrigerant, MFR #R410A lists Trane as the manufacturer;

however, the referenced part number appears to be associated with Forane.

Please confirm the correct manufacturer for each applicable line item.

All the manufacturers are Trane. Item 7 doesn’t have a manufacturer due to it being refrigerant. That can be any manufacturer. Alternate manufacturer can be bid but must have a specification submittal for review.
