About this file

This Addendum No. 1 document, issued by the Coastal Bend Bays & Estuaries Program (CBBEP) in coordination with the U.S. Fish and Wildlife Service (USFWS) and engineered by HDR Engineering, Inc., addresses berm repairs at the Matagorda Island Unit of Aransas National Wildlife Refuge in Texas. The project involves repairs at two discrete locations: BC-SR-1 (culvert replacement) and DC-SR-1 (breach filling and culvert installation), along with installing graded riprap shoreline protection and topping the berm with recycled asphalt. Owner-furnished materials include approximately 1,020 cubic yards of R-150 graded riprap, 45 cubic yards of bedding stone, 4,200 cubic yards of sand fill to be harvested on-site, 300 cubic yards of oyster shell/recycled runway mix material, and concrete debris. The pre-bid conference was held virtually on August 27, 2026, with a site visit scheduled for August 28, 2026, at 9:00 a.m. at ANWR Headquarters. The deadline for questions is September 11, 2026, at 5:00 p.m., and bids are due September 18, 2026, at 2:00 p.m. at the HDR office in Corpus Christi, Texas. Contractors must commence mobilization before December 1, 2026, and complete all on-island work by February 28, 2027.

Payment is structured as a per-linear-foot basis for levee cap work and lump-sum percentage-of-completion payment for all other items. The project requires coordination with the USFWS dock in Port O'Conner for equipment and material access, located approximately 25 miles from the work sites at the island's south end. Contractors may be eligible for compensation for documented standby costs and schedule adjustments if work is suspended due to whooping crane conservation measures, which restrict activities within 1,000 feet of cranes and generally limit work to daylight hours starting November 1, 2026. A registered Texas professional land surveyor is required for initial, interim, and final surveys. The site presents significant logistical challenges, including limited equipment access via an unimproved 25-mile access road, no water access to work areas (all work is land-based), and adjacency to environmentally sensitive habitat including marsh, oysters, and seagrass. Additional considerations include scheduled hunts on the island in November and December 2026 and concurrent oil and gas decommissioning activities.

Subject: Prospective Bidder Questions and Answers

Date: Tuesday, September 08, 2026

This memorandum documents questions from prospective bidders received through September 4th and the Owner’s response.

Questions and Answers:

Question 1: Is the U.S. Fish and Wildlife Service dock in Port O’Conner available for this project?

Answer 1: Yes, U.S. Fish and Wildlife Service have agreed for the use of their dock within Port

O’Conner for the usage of moving materials and equipment to the north dock on Matagorda Island.

The U.S. Fish and Wildlife Service dock is located at: 28°26'15.35"N, 96°25'6.23"W

The Contractor shall not have exclusive use of the dock and shall be responsible for coordinating all dock access and operations with the U.S. Fish and Wildlife Service. The Contractor shall schedule dock usage in advance and conduct its operations in a manner that does not interfere with USFWS activities. Any limitations on dock availability, access times, or operational restrictions imposed by

USFWS shall be incorporated into the Contractor's work planning and schedule.

Question 2: Will standby time be paid for Whooping Crane delays and will there be a time extension for the contractor?

Answer 2: In the event that construction activities are suspended due to restrictions associated with whooping crane conservation measures, the Contractor may be entitled to compensation for documented and substantiated standby costs and/or an adjustment to the Contract Time, subject to review and approval by the Owner.

Requests for compensation or additional Contract Time shall be submitted in accordance with the

Contract requirements and shall include sufficient documentation substantiating the cause of the delay, the duration of the impact, and the resulting effect on the Contractor's operations and project schedule.

Documentation may include:

• The date, time, and duration restrictions were imposed.

• Documentation of notification to the Designated Whooping Crane Specialist and the response received.

• Daily reports documenting when work stopped and the work activities affected.

• Crew and equipment logs showing resources that were unable to perform work.

• Evidence that alternative work could not reasonably be performed.

• The resulting impact on the project schedule.

The Contractor shall take reasonable measures to mitigate delay impacts, including resequencing work where practical. Any determination regarding compensation for standby costs or adjustment of

Contract Time will be based on the specific circumstances of the delay and the documentation provided, and will be made by the Owner in accordance with the Contract.
