The contract covers consumables and noncontract items for the fiscal period September 1, 2026, through August 31, 2027, with renewal options available. Bidders are required to submit this signed agreement as part of their bid submission for IFB HHS0017872. The warranty terms require contractors to guarantee that delivered products comply with all contractual requirements. Contractors must resolve complaints within 90 days of notification and provide point of contact information, cause and effect analysis, corrective and preventive actions, and either reimbursement or product replacement as agreed by HHSC. If any delivered product is found to be non-specification in part, the entire shipment must be reimbursed or replaced by the vendor without consideration for production run dates. Contractors must respond to problem notifications within 72 hours and bear all associated investigation costs, including storage fees beginning on the tenth day after vendor notification, HHSC employee time at $20 per hour beginning thirty days after notification, sample and shipping costs, and third-party laboratory testing at AMS FSIS-approved facilities. Failure to provide acceptable responses or meet required resolution timeframes will result in vendor tracking reports and discontinuation of HHSC food awards. The form must be signed by a company officer with authority to enter into fiscally and legally binding contracts.
