About this file
This document is a Part C Federal Conditions addendum to Solicitation No. 304T-27-380M1.2 issued by the Texas Comptroller of Public Accounts Statewide Procurement Division for Dairy and Juice Scheduled Deliveries. The solicitation applies to Texas Juvenile Justice Department (TJJD) and Texas Statewide Procurement (TSD) locations. The solicitation concerns the procurement of dairy and juice products for scheduled delivery to participating facilities. By submitting a bid, respondents certify compliance with all federal conditions outlined in the document.
The federal conditions establish mandatory requirements for contractor compliance across thirteen specific areas, including Buy American provisions requiring domestic commodities or products substantially produced or processed in the United States for National School Lunch Program and School Breakfast Program meals. Contractors must comply with civil rights laws prohibiting discrimination based on race, color, national origin, disability status, and age; health and safety regulations; clean air and water standards; solid waste disposal and recovered materials procurement requirements; and anti-lobbying and anti-kickback provisions. The solicitation explicitly excludes application of certain federal provisions—including the Davis-Bacon Act, Copeland Anti-Kickback Act, and Contract Work Hours and Safety Standards Act—because the contract is for the purchase of goods only and does not involve construction, repairs, or services. Additionally, contractors are prohibited from providing telecommunications or surveillance equipment produced by specified Chinese manufacturers including Huawei, ZTE, Hytera, Hikvision, or Dahua. Contractors must also make affirmative efforts to include small businesses, minority-owned enterprises, and women's business enterprises in subcontracting opportunities when applicable.
