About this file

This is a Proprietary Justification Memorandum submitted by the Texas Department of Motor Vehicles (TxDMV), Vehicle Titles and Registration Division, to justify a sole-source procurement of continued subscription access to the National Motor Vehicle Title Information System (NMVTIS) operated by the American Association of Motor Vehicle Administrators (AAMVA). The procurement seeks to maintain TxDMV's direct access to NMVTIS, the federally designated national database established under the Anti Car Theft Act of 1992, which is essential for performing real-time vehicle title verification, transmitting Texas title and brand records to the national database, and complying with federal reporting requirements. The system is used daily to verify titles before issuing Texas Certificates of Title for vehicles previously titled in other jurisdictions, prevent title fraud, identify stolen vehicles, and detect title washing. No alternative product or service can satisfy the agency's needs because NMVTIS is the only federally authorized system through which states must report title and brand information and conduct title verification activities. The justification document establishes that while third-party vendors approved by AAMVA may provide intermediary access to NMVTIS data, procuring services through such vendors would not eliminate dependency on NMVTIS, would introduce operational complexity and additional interfaces, and would create risks including delays in verification, increased integration requirements, reporting errors, and reduced data reliability.

The estimated procurement cost for fiscal year 2027 is $448,714, which covers NMVTIS transaction and participation fees. The justification emphasizes that selecting an alternative product or service would create significant operational and compliance risks that could result in interruptions to federally mandated reporting activities and increase the risk of title fraud or improper issuance of titles to stolen vehicles. The memorandum was dated July 28, 2026, and submitted by Annette Quintero, VTR Director, through Sonya Bebley, Director of Purchasing, to Daniel Avitia, Executive Director, for approval. The document was authorized for execution by Shelly Mellott, Deputy Executive Director, serving as designee for the Executive Director.

MEMORANDUM

To: Daniel Avitia, Executive Director Date: July 28, 2026 Texas Department of Motor Vehicles

From: Annette Quintero, VTR Director

Vehicle Titles and Registration Division

Through: Sonya Bebley, Director of

Purchasing

Subject: Proprietary Justification for procurement of AAMVA/NMVITIS subscription

Purpose: To obtain approval for a sole-source proprietary procurement.

User and Division: Contracts Unit, Program Administration, Vehicle Titles and Registration

Estimated Procurement Cost: $448,714 for FY27

Item(s) or Service Needed by TxDMV: The Vehicle Titles and Registration Division (VTR) requires continued access to the National Motor Vehicle Title Information System (NMVTIS), operated by the

American Association of Motor Vehicle Administrators (AAMVA), to fulfill federally mandated vehicle title verification and reporting requirements. NMVTIS is the national database established under the

Anti Car Theft Act of 1992 and serves as the authoritative source for vehicle title, brand, and theft information across participating states, insurance carriers, and salvage entities.

VTR utilizes NMVTIS to perform instant title verification checks before issuing a Texas Certificate of

Title for vehicles previously titled in another jurisdiction. The system is also used to transmit Texas vehicle title and brand information to the national database as required by federal law. In addition, TxDMV is required to pay NMVTIS transaction and participation fees associated with these activities.

The specification for this procurement requires direct access to the NMVITS, including the ability to perform real- time verification queries, submit Texas title and brand records to the national database and comply with all federal reporting requirements.

Continued access to NMVTIS is essential to support daily vehicle titling operations, prevent title fraud, identify stolen vehicles, detect title washing, and ensure the accuracy and integrity of vehicle ownership records maintained by the State of Texas.

No other product or service can fully satisfy the agency's needs because NMVTIS is the federally designated system through which states must report title and brand information and conduct title verification activities. While third-party vendors approved by AAMVA may provide access to NMVTIS data, those vendors are intermediaries and do not replace the underlying NMVTIS service itself.

TxDMV obtains services directly from the source database to which it is legally required to report information. Procuring access through another vendor would not eliminate the agency's dependency on NMVTIS and would introduce unnecessary operational complexity, additional interfaces, and potential risks. Selection of an alternative product or service would create significant operational and compliance risks, including delays in title verification, increased integration and maintenance requirements, potential reporting errors, reduced data reliability, interruption of federally mandated reporting activities, and increased risk of title fraud, title washing, or issuance of titles to stolen vehicles.
