About this file

This is a Warranty and Complaint Resolution Form for the Texas Health and Human Services Commission's procurement of candy and beverages for Big Spring State Hospital under Invitation for Bid (IFB) HHS0017656. The contract runs from the date of award through August 31, 2027. The form establishes the contractor's obligations regarding product warranty, complaint resolution procedures, and associated costs. Contractors must certify that products comply with all contractual requirements and commit to resolving complaints within 90 days of receipt. The complaint resolution process requires the contractor to provide a point of contact, conduct cause and effect analysis, implement corrective and preventive actions, and offer reimbursement or product replacement as agreed by HHSC.

The form specifies that contractors must respond to problem notifications within 72 hours and are responsible for all associated investigation costs, including storage fees beginning on the tenth day after vendor notification, HHSC employee hours at $20 per hour beginning 30 days after notification, sample or case costs, shipping, warehouse expenses, and third-party laboratory testing at FSIS-approved facilities. If delivered products are found to be non-specification, the entire shipment will be reimbursed or replaced by the vendor regardless of production run dates. Failure to provide acceptable responses, meet resolution requirements, or adhere to specified timeframes will result in vendor tracking reports and discontinuation of HHSC food awards to both the vendor and manufacturer. All bids must include a signed version of this form executed by a company officer with authority to bind the organization legally and fiscally.
