SECTION I – INTRODUCTION AND STATEMENT OF WORK
1 INTRODUCTION
The Texas Department of Agriculture (TDA or Department), an agency of the State of Texas, issues this REQUEST FOR PROPOSAL (RFP) to solicit responses from qualified Respondents for pesticide disposal services, as described in this Section I and in this solicitation. TDA’s objective is to obtain the services that represent the best value for TDA and the State of Texas, according to the terms and conditions of this solicitation.
This includes hosting pesticide waste collection events in coordination with the Texas Department of Agriculture, where participants can drop off unwanted pesticides, free of charge, for proper disposal by the selected Respondent.
RESPONDENTS ARE CAUTIONED TO READ THE INFORMATION CONTAINED IN THIS SOLICITATION
CAREFULLY AND TO SUBMIT A COMPLETE RESPONSE TO ALL REQUIREMENTS AND QUESTIONS AS
DIRECTED.
All costs associated with the solicitation must be included in Respondent’s Proposal. Solicitation responses that do not meet all the requirements or contain all the required documentation specified in this solicitation may be rejected as non-responsive.
2 BACKGROUND
Established by the Texas Legislature in 1907, TDA was created to gather statistics on crops and livestock and to educate farmers on advanced farming methods and practices.
Over time, TDA’s responsibilities expanded significantly, including the absorption of the T e x a s D e p a r t m e n t of Rural Affairs and the State Office of Rural Health in 2011.
TDA touches the lives of nearly every Texas citizen and is charged with protecting consumers by ensuring standards are upheld with licensed professionals and businesses. These standards provide an environment for consumers to conduct business with confidence with those licensees. TDA serves the public by providing public protection, consumer confidence and health protection.
The Department has regulatory responsibility to ensure licenses are appropriately issued and renewed. TDA strives to provide accessible and responsive services that strengthen public safety and consumer protection. Today, TDA performs a wide variety of regulatory, nutrition, economic development, and marketing activities, such as:
1) Regulating the production and transport of agricultural commodities and reviewing commodity board budgets;
2) Administering numerous federal and state nutrition assistance programs for children and adults;
3) Regulating agriculture-related activities in the marketplace to protect consumers, such as retail package content and weighting device calibration and the registration and use of agricultural, residential, and commercial site pesticide applications;
4) Providing financial assistance for agribusinesses and rural enterprises, rural healthcare
PCO 805 RFX Template Page 6 of 42 Version 5.3 Revised 06.26.2026 facilities, and community infrastructure projects to promote economic development in rural Texas; and
5) Promoting Texas agricultural and rural products locally, nationally, and internationally.
In 2019, the Texas Legislature established the Pesticide Disposal Fund to cover the cost of administering pesticide waste and pesticide container collection activities by its enactment of House Bill 191. TDA is charged with coordinating the collection events, which are intended to give agricultural producers an opportunity to properly dispose of banned or unwanted pesticides. The events are free and voluntary for eligible participants. Pesticides held in storage for a long time are more prone to leading and are susceptible to damage from fires and natural disasters, which can cause a negative environmental impact.
Between October 2021 and July 2025, TDA held twelve pesticide waste disposal events, which received ample participation signifying the continued importance for such events in the agricultural community. Between these events, over one million pounds of pesticide waste was collected from 806 participants. Events have been held in the following Texas counties: Dawson, El Paso, Erath, Grimes, Henderson, Hidalgo (2 events), Medina, Moore, Nueces, Tom Green, Victoria, and Wichita.
Events participation is still expected to be high during the next Contract period as we service communities where events have not been held in nearly a decade. This will allow for 2-3 events per year with increased and more frequent events over time.
