About this file
This is Addendum No. 1 to Request for Proposal (RFP) #754-STEM FF&E-2026 issued by Texas State University on May 19, 2026, for the procurement of furniture, fixtures, and equipment (FF&E) for the STEM Classroom Building at its San Marcos campus. The RFP solicits proposals for twelve base packages of furniture and finishes, with respondents permitted to bid on one or more packages. The original RFP was posted on May 12, 2026, with proposals due by June 2, 2026, at 2:00 p.m. Central Time. Contract commencement is scheduled for July 1, 2026, with delivery and installation to begin on October 5, 2026, and be completed no later than December 1, 2026. The University anticipates an award decision by June 11, 2026. No mandatory pre-proposal conference is being held, but a post-award and pre-installation conference will be conducted at the University's discretion.
The addendum addresses two key questions regarding product substitutions. The University has clarified that substitutions for basis of design products will be accepted to encourage broader participation and allow additional qualified dealerships to submit competitive bids. Substitute products must be submitted with the original June 2, 2026 deadline for approval. The specifications establish that basis of design products serve as reference standards and the burden of proof of equality rests with the contractor. If a substitution is accepted and subsequently proves defective or unsatisfactory within the guarantee period, the contractor must replace it with the specified product at no additional cost to the University. The designer retains final decision authority on all substitution requests. Samples of proposed substitutes and specified items may be required for comparison purposes.

NOTES
SUBSTITUTION OF FURNITURE AND FINISHES
SUBSTITUTION OF FURNITURE AND FINISHES
A. The “basis of design” (BOD) products are the specific products shown on the Drawings and indicated as such in the specifications.
B. It is not the intent of the Drawings and/or Specifications to limit products to any particular manufacturer nor to discriminate against an "approved equal" product as produced by another manufacturer. Some proprietary products are mentioned to set a definite standard for acceptance and to serve as a reference in comparison with other products. When a manufacturer's name appears in these Specifications, it is not to be construed that the manufacturer is unconditionally acceptable as a provider of equipment for this project. The successful manufacturer or supplier shall meet all of the provisions of the appropriate specification(s).
C. The specified products have been used in preparing the Drawings and Specifications and thus establish the minimum attributes that substitutes must be considered acceptable. The burden of proof of equality rests with the Contractor. The decision of the designer is final.
D. When requested by the University/Architect, the Contractor shall provide a sample of the proposed substitute item. In some cases, samples of both the specified item and the proposed item shall be provided for comparison purposes.
E. Should a substitution be accepted, and should the substitute material prove defective, or otherwise unsatisfactory for the service intended within the guarantee period, this material or equipment shall be replaced with the material or equipment specified at no additional cost to the Owner.
