About this file

This is Amendment No. 1 to Invitation for Bid (IFB) No. IW242194 issued by the Texas Department of Criminal Justice (TDCJ), Contracts and Procurement Department, with Amaya Byrd serving as the purchaser/contract specialist. The amendment provides clarification responses to nine bidder questions regarding the procurement of six shipping containers for delivery to the Daley Unit. Key specifications established through the amendment include: containers must be new 40-foot units (with both Standard Height 8'6" and High Cube 9'6" variants accepted as equivalents meeting specifications), ground-level placement is required, offloading equipment and services are the vendor's responsibility, delivery must occur Monday through Friday between 8:00 AM and 5:00 PM, and the preferable delivery deadline is May 31, 2026. The bid opening was scheduled for May 20, 2026, at 3:00 PM, and bidders were required to acknowledge receipt of this amendment in their bid submissions to receive consideration.

Pricing must be quoted on an F.O.B. destination basis with freight prepaid, and standard payment terms are Net 30 from receipt of correct invoice and acceptance of goods. No country-of-origin restrictions apply to the shipping containers, and all items meeting the required specifications will receive consideration in the bid review process. There are no pre-delivery security clearance or background check requirements for vendor delivery personnel, though security will escort personnel upon arrival and coordinate access at the facility. The prepared concrete foundations at the facility will accommodate container placement, and offloading will occur outside the facility perimeter. No site visit, bidder conference attendees, award date, or contract term information is provided in this amendment document.

Question

Answer

1 The solicitation and Standard Terms and Conditions do not appear to explicitly state whether the shipping containers must be American made or manufactured using American sourced materials, outside of the certifications required under the Foreign Adversaries provision (Section 38) and Critical Infrastructure provision (Section 40).

Could you please clarify whether there are any COO restrictions for this procurement? Specifically:

Must the shipping containers be manufactured in the United States?

Are there any requirements that materials used in the construction of the containers be American sourced?

All items that meet the required specifications are considered in the bid review process. There aren’t any preferences that the items be made only in the United States.

2 Offloading Equipment:

Does TDCJ Daley Unit have on-site equipment (forklift, crane, or similar) available to offload the shipping containers upon delivery, or is the vendor required to provide offloading services and equipment as part of the delivery?

The vendor is responsible for offloading. TDCJ has no department on the unit that has a forklift or equipment suitable to unload items of this nature.

3 Delivery Coordination:

Are there specific delivery time windows, advance-notice requirements, or scheduling procedures for deliveries to the Daley Unit outside standard business hours (Monday-Friday, 8:00 AM - 5:00

PM)?

The delivery time window is Monday- Friday, 8:00AM-5:00PM.

4 Container Placement:

Will the shipping containers be placed on a prepared foundation or at a designated ground location coordinated by TDCJ, or will the vendor coordinate the final placement with the Unit Warden or facility staff?

Yes, there are prepared foundations for each shipping container. Concrete slabs were poured in advance.

5 Security Clearance Process:

Is there a pre-delivery security clearance or background check process required for vendor delivery personnel, or will security escort and access coordination be handled upon arrival at the facility on the day of delivery?

No pre-delivery security clearance or background check process is required.

Delivery personnel will be escorted by security or the warden. The items will be offloaded outside of the facility.

6 "Or Equivalent" / High Cube substitution.

The specification calls for new 40' Standard Height containers (8'6"). New 40' High Cube containers (9'6") are the predominant new-build inventory currently available at TX depots and exceed the standard spec in capacity. Will TDCJ accept new 40' High Cube containers as an approved equivalent? If not, please confirm only Standard Height (8'6") will be accepted.

TDCJ accepts bids for all alternate items that meet the required specifications.

7 Delivery deadline. The IFB does not specify a required delivery date. Please confirm the deadline by which all 6 containers must be delivered, offloaded, and accepted at the Dalby Unit.

The preferable delivery deadline is 05/31/2026.

8 Offloading equipment at delivery site.

Will TDCJ provide forklift, crane, or other lifting equipment at the Dalby Unit for offloading? If not, please confirm that tilt-bed delivery (ground-level placement by the carrier) is acceptable.

TDCJ will require ground-level placement. A forklift will not be available at the time of delivery.

9 Payment terms. Please confirm the payment terms for the resulting purchase order (e.g., Net 30 from receipt of correct invoice and acceptance of goods).

Correct, standard payment terms are Net 30.
