About this file

This is a Request for Proposal (RFP) issued by the Texas Commission on Environmental Quality (TCEQ) for Print on Demand (POD) and Fulfillment Services under Solicitation Number 582-27-23154. The TCEQ seeks a contractor to warehouse, manage, and fulfill orders for approximately 200 to 250 publication items annually, including publications, posters, promotional items, and forms. The contractor will provide warehousing for pre-printed documents, produce print-on-demand items as needed, and supply offset printing in contingency situations. Currently, 42 pre-printed items are maintained in inventory, with historical fulfillment volumes ranging from 2,657 to 4,287 orders annually across fiscal years 2024 through 2026. Responses are due May 29, 2026, at 2:00 PM Central Time, with a deadline for vendor questions set for May 12, 2026. The contract period commences September 1, 2026, and expires August 31, 2028, with three optional one-year renewal periods available. The contractor's warehousing facility must be located within a 25-mile radius of TCEQ Headquarters in Austin, Texas. No pre-proposal conference is scheduled, and the procurement method is Competitive Sealed Proposals under Texas Government Code Chapter 2156, Subchapter C.

Pricing is firm and fixed with costs submitted on a detailed price form covering startup and implementation fees, system access, warehousing (per pallet and bin locations monthly), inventory management, print-on-demand production (varying by paper type, color, and binding method), and order fulfillment services. A Historically Underutilized Business (HUB) Subcontracting Plan is not required, as TCEQ has not identified subcontracting opportunities and anticipates the contract value to be less than $90,000, including all renewals. The contractor must maintain insurance coverage including Workers' Compensation, Commercial General Liability ($2,000,000 combined), Commercial Automobile Liability ($1,500,000), Excess Liability ($1,000,000), Cyber Liability ($1,000,000), and Professional Liability ($1,000,000). Performance criteria require the contractor to process and fulfill a minimum of 98 percent of valid domestic orders within two business days, generate 98 percent of required reports by specified deadlines, maintain inventory records with less than 1 percent error, and ensure online system access with less than 1 percent downtime during normal working hours. Liquidated damages apply for failure to meet these performance standards, assessed as percentages of monthly fulfillment charges or storage fees. This contract is funded with federal funds, and the maximum TCEQ obligation amount is identified as a variable to be determined during award.

To determine the most advantageous Response, in addition to price, TCEQ may consider other relevant criteria, which are described more fully in Section 2, Evaluation Criteria. TCEQ may use information regarding the Responder’s performance on past TCEQ contracts in the evaluation of qualifications. In addition, TCEQ will use the information contained in the Texas Comptroller of Public Account’s vendor performance tracking system in the evaluation of qualifications.

Selection

Depending on the applicable procurement method and solicitation type, in order to secure the best value for the State, TCEQ may take one or more of the following actions in the selection process:

• Accept the highest scoring Response without changes.

• Request clarifications, assurances, and corrections.

• Modify the selection criteria and apply it to BAFOs, provided that the modifications do not materially affect initial applicant eligibility or invitation to submit a BAFO.

• Select the highest scoring BAFO and accept it without changes or negotiate acceptable terms.

• Award one or more contracts based on the amount of work that TCEQ foresees needing performed.

• Award contracts to other contractors at a later date under this Solicitation or through another appropriate method, including another solicitation.

• In the case of a tie that cannot be resolved by application of one or more statutory preferences, make a selection, in the best interest of the State, by drawing lots, tossing a coin, or drawing names with two witnesses to oversee the tiebreaking activity.

Section 2252.908 of the Texas Government Code states that a state agency may not enter into certain contracts with a business entity unless the business entity submits a disclosure of interested parties (Form 1295) to the state agency at the time the business

582-27-23154 POD and Fulfillment Services Page 7 of 86 entity submits the signed contract to the state agency. The contract is voidable if the business entity fails to provide the disclosure of interested parties as required by statute.

SCOPE OF WORK

1. GENERAL BACKGROUND

The Texas Commission on Environmental Quality (TCEQ) stores and maintains approximately 200 to 250 publication items annually. Examples of items include publications, posters, promotional items (such as stickers, decals) and forms. TCEQ is seeking a contractor to warehouse and fulfill orders for pre-printed documents, and on occasion produce and ship Print-on-Demand (POD) items and provide off-set printing in contingency situations.

A. Pre-Printed Stock

Currently 42 pre-printed items are available. These items include general information, instructional, and promotional materials produced in large quantities. The most cost-effective way to produce large quantities is digital or offset printing. Once printed by one of TCEQ’s print Contractors, the publications and promotional items are boxed, labeled, and palletized for storage in the POD/Fulfillment Contractor’s warehouse until needed for filling orders. (See Appendix A).

B. Print-on-Demand

TCEQ currently maintains POD items, which include regulatory guidance documents and financial or statutory reports required by state or federal guidelines. When an order is received for a POD item, a single or limited number of copies are printed for that specific order and shipped to the party requested.

POD items are not warehoused. (See Appendix B)

C. Item Numbering

TCEQ maintains a separate numbering system for documents, forms, and promotional items. All items have these numbers printed on them along with a “new” or “revised” date. Examples: RG-123 (rev. 06/20), TCEQ-00123 (06/20), M- 036 (06/20). For a list of items and their designations, visit www.tceq.texas.gov/publications/search-pubs OR see Appendix A.

D. Web-based Inventory Management and Fulfillment System

TCEQ receives orders from all over Texas. TCEQ requires the Contractor to provide a web-based inventory management and fulfillment system. The system must operate in real-time and provide up to date inventory levels and tracking order status at any given time. The system must also be able to accept and fulfill orders directly from the Take Care of Texas website.

2. DESCRIPTION OF ACTIVITIES TO BE PERFORMED BY CONTRACTOR.

A. Contract Start-up and Management

The Contractor must begin work immediately after the start of the contract period listed on the signature page of the Contract. Any transition between an incumbent contractor to the awarded Contractor must occur seamlessly with no interruption or break in providing quality service. The awarded Contractor will be expected make inquiries necessary to allow for a complete and seamless transfer of responsibilities.

TCEQ will designate a contract manager to liaison between TCEQ and the Contractor. The Contractor agrees to comply with all reasonable requests and printing directives of the TCEQ Contract Manager or designee, including requests for information relating to the work that is the subject of this contract. TCEQ will notify the Contractor in writing if TCEQ wishes to officially designate a different Contract Manager or designee.

1) Implementation Plan

The implementation plan shall detail the responders plan for transitioning physical, palletized inventory between the previous contract holder and themselves. This plan shall also include set –up of the Contractor’s web-based inventory management and fulfillment system (“storefront”) and integration of all titles. Any performance/user testing should also occur within this time. All costs related to testing must be included in the price for Storefront System Setup. The implementation plan shall be enacted within 10 business days of contract effective date.

2) Transition Out Plan

If, at the end of the Contract, for any operations that the Contractor performs that will be transferred to TCEQ staff or another contractor (Succeeding Contractor), 582-27-23154 POD and Fulfillment Services Page 13 of 86 the Contractor is expected to ensure that there is a smooth transition of these operations to the TCEQ staff or Succeeding Contractor and will provide complete cooperation and efforts to complete such transition. Transition to TCEQ staff or Succeeding Contractor must occur with no interruption or break in service. During this transition period and prior to the expiration of the Contract, the Contractor will continue to be in charge and solely responsible for all operations.

B. PRINT-ON-DEMAND (POD)

Print-On-Demand is used for items where stocking levels are hard to determine.

For these items, the Contractor will not receive stock but will instead print out copies to fill orders as they come in from TCEQ. All documents intended for print-on- demand are available in PDF format. All paper used to print TCEQ materials must contain at least 30% recycled content. TCEQ typically uses 110 lb. cover and 20 lb. text weight in its POD documents. Additional weights and varieties are subject to TCEQ approval before use.

C. CONTINGENCY OFF-SET PRINTING

In contingency situations where the mandated State-run print shops are not available or are unable to produce the work to specifications Contractor may be requested to perform off-set printing of a limited number of documents. Price for the contingency off-set printing will be n egotiated at the time the service is needed.

D. INVENTORY

TCEQ requires the Contractor to provide a web-based inventory management and fulfillment system. Between 3-5 TCEQ staff members with administrative access would need to be able to access the system on a daily basis. The system must operate in real-time, providing inventory levels and tracking order status at any given time for all items. (See Section 3:Reports).

Contractor may be asked to update the inventoried items daily. TCEQ shall send Contractor an email with publication title, date, quantity to be delivered and stored with a digital thumbnail. Inventory consists of any publication produced or distributed by TCEQ, including print-on-demand documents that are new, reprints without revisions, or revised.

1) Receiving Pre-Printed Items

State print shops, or another print facility, shall deliver items directly to the Contractor. Following delivery, Contractor shall provide a “receiving report” to TCEQ within one (1) business day of receiving a delivery of pre-printed items..

The report must include the date received, item number, item title, quantity received, and quantity per box (if available), plus information on any damage to product and quantity of damaged materials. (see Section 3: Reports).

TCEQ will verify the delivery and quantity and send an emailed Release to Warehouse to the contractor approving the receiving report. This notice allows the Contractor to begin distributing the item. The release to distribute notice will include the following information and/or attachment (*), as applicable to the item:

582-27-23154 POD and Fulfillment Services Page 14 of 86

Item type: Print-on-Demand/Pre-printed

Item title: Item number and title

Item status: New / Reprint / Revised

Inventory Level Alert: Preset amount

Recycle stock: Yes / No

Item URL: tceq.texas.gov/xxxxx

*Thumbnail image: .jpg file

Revised Items – Items identified as “revised” shall be recycled or returned to TCEQ within (five) 5 business days, if so designated by the TCEQ Contract Manager in writing.

Out-of-Print Items – Items identified as “out-of-print” shall be recycled or returned to TCEQ within five (5) business days, if so designated by the TCEQ contract manager in writing.

2) Inventory Level Alerts

TCEQ will provide the Contractor with an “inventory level alert” for each item.

When an item quantity reaches that level, the Contractor must notify TCEQ staff. TCEQ will take appropriate steps to either replenish the inventory level, temporarily designate the item print-on-demand pending a revision, or designate the item “out-of-print.” (see Section 3: Reports)

E. WAREHOUSING OF PRE-PRINTED STOCK

TCEQ requires a Contractor that has a fully enclosed, climate-controlled building to house its pre-printed stock. The Contractor’s warehouse must meet all applicable state of Texas and city building codes. Warehouse facilities must contain adequate space and equipment for loading and unloading material palletized for delivery and storage. Facilities must have loading docks suitable for trucks with lift gate and pallet jacks.

The Contractor must be able to accept delivery of materials between 8:00 a.m. and 5:00 p.m., Monday through Friday, excluding federal and state of Texas holidays, unless otherwise specified.

On occasion, TCEQ receives urgent requests for warehouse materials. In such cases, TCEQ staff must be able to pick up materials from the Contractor within 2 hours (see Section F.7: Priority Orders). TCEQ requires the Contractor warehousing facility to be within a 25-mile radius from TCEQ Headquarters located at 12100 Park 35 Circle, Austin, Texas, 78753.

F. ORDER FULFILLMENT

The Contractor must use a web-based system (storefront) to manage and fulfill orders.

TCEQ prefers seamless integration with all the major freight carriers, allowing the Contractor to ship orders with minimal human intervention. All orders must include a packing slip and be processed within two (2) business days; time begins when the Contractor receives an order and stops when the order is mailed or shipped. Orders received after 2:00 p.m. are considered the next business day.

1) Postage

582-27-23154 POD and Fulfillment Services Page 15 of 86

TCEQ contracts separately with shipping companies and shall provide the Contractor the necessary information for shipping. Kitted material will be shipped using the TCEQ Pitney Bowes – Bound Printed Material (BPM) account.

Publication orders regardless of weight will be shipped via FedEx-Ground. Any changes in use of these companies will be communicated to the Contractor by TCEQ at least a week prior to the change.

2) Shipping Errors

The Contractor must be prepared to rectify any shipping errors made by the Contractor, to include payment of re-shipping at no expense to either TCEQ or the customer. Time is of the essence. The Contractor must pay for overnight shipping at no expense to either TCEQ or the customer and expedite the order the same business day the Contractor is notified of the error.

3) Packaging

All materials used for packaging by the Contractor are subject to TCEQ approval before use.

The Contractor is restricted from advertising his/her company on packing supplies containing TCEQ materials, unless previously approved by TCEQ as noted above. The Contractor must provide all packing supplies such as labels, envelopes, boxes, and packing material. TCEQ requires non-plastic packing materials, such as shredded paper, except in circumstances where the product requires special packaging.

Packaging must include the TCEQ-specified return address and logo provided by TCEQ. TCEQ shall provide this information to the Contractor upon contract award. Addressing is acceptable in one color (black is considered a color).

4) Kitting

The Contractor must be able to assemble kits containing predetermined items.
