About this file
This Addendum No. 1 to Invitation for Bids (IFB No. 304T-26-325M2.1) issued by the Texas Comptroller of Public Accounts Statewide Procurement Division provides clarifications and responses to ten questions submitted by prospective respondents regarding the animal feed, vitamins, and supplements procurement for the Texas Department of Criminal Justice and Department of Public Safety. The addendum addresses critical requirements including licensing obligations under Texas Agriculture Code Chapter 141, pricing structure clarifications for various line items, storage tank specifications at delivery locations, and insurance documentation requirements. Specifically, the addendum confirms that prime contractors may satisfy licensing requirements through licensed feed manufacturers, distributors, or subcontractors rather than independently holding a Texas commercial feed license; clarifies that pricing for lines 6-7 and 13-21 utilizes Manufacturer's Price List plus a firm Contractor's Constant with no escalation; identifies that three delivery locations (Coffield Unit in Tennessee Colony, Wainwright Unit in Lovelady, and Ellis Unit in Huntsville) contain 6,000-gallon storage tanks capable of holding 25-ton truckloads of liquid feed; and specifies that certificates of insurance must be addressed to the Texas Comptroller of Public Accounts at 111 East 17th Street, Austin, Texas 78711. Additionally, the addendum permits respondents to submit pricing information using either XML or XLSX formatted mandatory price sheets.
The addendum emphasizes compliance requirements and operational logistics without introducing changes to core solicitation terms, deadlines, or evaluation criteria. All responses must include a signed acknowledgment of receipt of this addendum; failure to return the signed addendum may result in disqualification. The clarifications provided serve to remove ambiguities regarding contractor responsibilities, licensing pathways, pricing methodologies, and facility specifications to enable qualified suppliers to submit compliant and competitive bids for this multi-year contract supporting state agency livestock feeding operations.

Questions and Answers IFB No. 304T-26-325M2.1 Title:
Question No.
Question Answer
Please confirm whether the manufacturer/distribution license requirement may be satisfied by the licensed feed manufacturer, distributor, or subcontractor supplying the product, or whether the prime contractor must independently hold a Texas commercial feed license at the time of bid submission or award.
Reference Section A.7.1 which states: "Per Texas Statute, Agriculture Code, Chapter 141 - Commercial Feed, Section
141.001 and 141.021, a person may not manufacture or distribute commercial feed in this state without a valid current license issued by the Texas Feed and Fertilizer Control Service for each feed facility that manufactures or distributes commercial feed. A person making only retail sales of commercial feed bearing the label of a licensed manufacturer, guarantor, or distributor is not required to obtain a license."
Prime Contractor Licensing under Texas Agriculture Code, Chapter 141 (ref. Part A §A.7.1; Attachment F, Lines 1, 2–3, 6–7, 12) Attachment F repeatedly requires conformance with Texas Agriculture Code, Chapter 141 - Commercial Feed. Could the State confirm whether (a) the prime contractor must hold a current Texas commercial feed license, or (b) it is sufficient for the prime to source through licensed feed manufacturers, distributors, or feed mill subcontractors?
Reference question and answer 1.
In Section A.4.2 of the package, the invitation states that the Manufacturer's Price List + Contractor's Constant is applicable to Lines 6-7 and Lines 13-21 of the IFB. However, in Attachment F, on Page 5, Item 4 states that the Pricing Structure for Lines 6-7 is 'Firm with no escalation'. In addition, on Page 13 of Attachement 5, Item 5 states that the Pricing Structure for lines 13-21 is 'Firm with no escalation'.
These two sections of the IFB are not consistent in terms of the pricing to utilized when bidding. Will you please clarify the Pricing Structure that is acceptable for Lines 6-7 and Lines 13- 21 of the IFB?
There is no inconsistency between Part A and Attachment F.
Section A.4.2 states: "Contractor's Constant must be firm, all-inclusive prices at a fixed rate for the life of the contract." The references in Attachment F to Section A.4.2 are to direct prospective Respondents to Section A.4.2 for how the price per ton will be calculated. Again, the Contractor's Constant can not be increased during the life of the contract.
