About this file
This is an Addendum #1 Questions and Answers document for Solicitation HHS0017035 issued by the Texas Health and Human Services Commission's Procurement and Contracting Services division on behalf of the Department of State Health Services for biomedical destruction services. The solicitation addresses multiple service types including recycling and repurposing of materials, liquid and solid waste disposal, and infectious biohazardous regulated medical waste disposal across three primary service locations with potential expansion to other HHS regional locations as needed. The services are project- and incident-based with variable volumes ranging from a few dozen to over one thousand pallets per engagement. The awarded vendor must be capable of providing all requested services, though pricing submission is limited to biomedical waste on a per-pound basis. The solicitation questions deadline was May 12, 2026, with the response deadline of June 3, 2026, at 10:30 a.m. CST, and the anticipated contract start date is September 1, 2026, for an initial one-year term through August 31, 2027, with three optional one-year renewals and a potential one-year extension.
Key requirements stipulate that vendors respond to service requests within one hour with actual service completion to be agreed upon once contacted and continued until finished. The vendor must provide 24-hour, seven-days-a-week, 365-days-a-year contact availability, conduct background checks on all drivers and service personnel at vendor expense, and submit proof of completed checks to HHS. While the solicitation references services beyond those listed on the pricing sheet, only biomedical waste disposal pricing is requested; vendors must invoice services at an amount not exceeding material costs plus ten percent markup. Vendors are responsible for conducting their own background checks rather than utilizing state-conducted checks, and the vendor is expected to support emergency response operations for disaster, emergency, and incident situations as required by the HHS program.

Addendum #_1_ - Solicitation Q&A
Solicitation Title: Biomedical Destruction Services
Solicitation Number: HHS0017035
Reference (If Applicable)
Question Response
1.
Should vendors upon their review have any requested edits to either the ‘Solicitation/IFB’, ‘Exhibit A – HHS Solicitation Affirmations’ or ‘Exhibit B – UTCs and HHS Affirmations – No DUA’, should they have them included with their submitted proposal for review?
Yes.
2.
With regard to the “7 Scope of Work” on Pages 11 through 19 of the ‘Solicitation/IFB’ packet, who is the current vendor providing services? What are the current rates of service?
Information regarding current vendor and/or current rates would require an Open Records Request with the
State of Texas
3.
through 19 of the ‘Solicitation/IFB’ packet, there appears to be multiple different services being requested such as recycling/repurposing services of different materials, liquid/solid waste disposal services and infectious biohazardous regulated medical waste.
Are you able to provide more detailed information regarding each service type including the estimated annual volume of waste being disposed of per pickup or per year? Is there a specific service that will be required more than others? Is it required for the awarded vendor to provide all services requested? If required for all services to be provided, ‘Exhibit C – Pricing Sheet’ only references pricing needed for biomedical waste.
Are you able to provide more detailed information regarding each service type including the estimated annual volume of waste being disposed of per pickup or per year? As this is project or incident based, there is not a consistent volume. However, previous projects have ranged between a few dozen to over a thousand pallets over an appropriate amount of time.
Is there a specific service that will be required more than others? UNK. Situation dependent.
Is it required for the awarded vendor to provide all services requested? Vendor must be able to provide all services requested. Vendor must be able to provide all services requested. A specific request may ask for the disposal of one or more types of waste, but vendor should be available and prepared to respond to all.
4.
through 19 of the ‘Solicitation/IFB’ packet, “7.1(f)” states that vendors shall invoice services at an amount not greater than the cost of materials plus 10% markup however ‘Exhibit C – Pricing Sheet’ references a per pound disposal rate for biomedical waste only and the requested pricing in the SOW does not include other operational costs to provide services to these locations. Is this requested invoicing requirement for services a mandatory requirement in order to be awarded the bid?
It is understood there are other services other than what is listed on the Pricing Sheet. Per the Scope Of Work the awarded bidder will be expected to perform all of the services listed. For the purposes of the solicitation we are only asking for pricing for the services listed on the Pricing Sheet.
5.
Per “7.1.1 Service Location(s)” on Pages 12 and 13 of the ‘Solicitation/IFB’ packet, it states that there are three (3) sites that are in need of services while also referencing that other HHS region locations may need services in the future. Are these the only 3 sites that are requiring services? If there are other locations that are currently receiving services or will be needing services, are you able to provide a listing of those sites, the services that they are needing and average or estimated volume of waste that they are disposing of per pickup or per year?
Are these the only 3 sites that are requiring services?
No
If there are other locations that are currently receiving services or will be needing services, are you able to provide a listing of those sites, the services that they are needing and average or estimated volume of waste that they are disposing of per pickup or per year?
No. This is situation dependent and according to the needs of the disaster/emergency/incident.
6.
Per “7.1.3 Services Outside Regular Business Hours” on Pages 13 of the ‘Solicitation/IFB’ packet, it states that emergency services be provided within one (1) hour of notification and continue work until the services requested are complete to the satisfaction of the HHS Agency. Is this a mandatory requirement for vendors? Although emergency services have been provided within this time frame, we cannot guarantee that all emergency services can be provided during this time frame.
Is this a mandatory requirement for vendors? Although emergency services have been provided within this time frame, we cannot guarantee that all emergency services can be provided during this time frame.
Vendors should reply back to the agency within 1 hour of being contacted, to provide services. The actual services will be agreed to once contacted and continued to be provided until completed.
7.
With regard to “7.1.10 Background Check for Personnel” on Page 16 of the ‘Solicitation/IFB’ packet, is there a specific State conducted background check that the vendor’s drivers/personnel servicing the locations will need to have completed or is it the responsibility of the vendor to conduct the background checks on each driver/service personnel and provide proof/information to HHS regarding the completed background check?
It is the responsibility of the vendor to conduct the background checks on each driver/service personnel and provide proof/information to HHS regarding the completed background check.
8.
With regard to “7.1.13 24-Hour Contact” on Page 17 of the ‘Solicitation/IFB’ packet, is it mandatory that vendors assign contact(s) who will be available 24 hours a day, 7 days a week to HHS should there be issues for service? We are able to provide contacts that will be available during regular business hours (M-F 8:00a-5:00p CST) and may also be available a little before or after regular business hours but will not be made available 24/7.
Yes. Program responds to and supports emergencies of varying types and scopes. Program must be able to contact the vendor 24 hours a day, 7 days a week, 365 days a year as needed.
