About this file
This is an Addendum to a Solicitation issued by the Texas Department of Public Safety (DPS) Procurement and Contract Services for the procurement of one wrecker truck. The addendum, effective April 29, 2026, extends the bid submission deadline from April 30, 2026, to May 6, 2026, at 5:00 PM Central Time. The solicitation seeks a Peterbilt 537 wrecker truck equipped with a Jerr-Dan 8.5-ton carrier with a steel deck measuring 24 feet by 102 inches, or equivalent specifications meeting all detailed technical requirements. Vendors must acknowledge receipt of this addendum prior to the revised submission deadline through one of three methods: by completing and returning three copies of the addendum, by acknowledging receipt on each copy of the offer submitted, or by separate letter or email referencing the solicitation and addendum numbers. Failure to acknowledge receipt may result in rejection of the offer. The anticipated contract award date is May 8, 2026, with a contract term of one year from the effective date and DPS reserving the right to extend performance for an additional six-month period.
The addendum corrects specifications in the Solicitation Exhibit F.8 Specifications Sheet, reducing the Gross Vehicle Weight Rating (GVWR) from 39,500 pounds to 33,000 pounds, resulting in a maximum of a Class 7 truck. The addendum provides vendor questions and DPS responses addressing alternative chassis options, toolbox sizing preferences, delivery requirements, and model year specifications. DPS confirmed that while the Peterbilt 537 is the preferred chassis, vendors offering alternative makes or models such as Freightliner, Western Star, or Kenworth are encouraged to participate provided their proposed units meet all updated specifications. DPS further clarified that the carrier need not be Jerr-Dan-specific but must include removable rails, that the 60-inch toolbox is preferred for maximum storage capacity, that the vehicle must be delivered as a turnkey product immediately ready for DPS use, and that the model year must be 2026 or later. Additionally, DPS confirmed that it is exempt from Federal Excise Tax (FET), with documentation available upon request to the awarded vendor.

Questions and Answers
Q: It looks like this is the 3rd or 4th consecutive time that this solicitation for a wrecker truck with a Peterbilt chassis has been opened. I'm simply curious if there is anything specific that has hindered a vendor from being awarded? The specs seem to be the same as the last two solicitations?
A: Multiple Solicitations are due to receipt of inadequate responses and minor changes to requirements. Please reference Solicitation Section C.2.1 for additional details on the changes made.
Q: Is Texas DPS exempt from FET?
A: Yes, documentation to show this can be provided to the awarded Vendor upon request.
Q: In regard to your requested GVWR of 39,500 pounds for a Peterbilt 537, the highest GVWR that model can reach is 35,500. We have confirmed this with our Peterbilt representative. Would you consider a Peterbilt 548? This model would reach the requested minimum GVWR of 39,500 pounds.
A: GVWR should be 33,000. We do not want to go up to the 548 model.
Q: Would any other makes or model chassis be acceptable as long as it fulfills the minimum GVWR requirements of 39,500 such as Freightliner, Western Star, or Kenworth?
A: The Peterbilt 537 despite its GVWR of 33,000 is preferred based on the success of our current units. Vendors who cannot provide the Perterbilt 537 are still encouraged to participate, so long as their proposed unit meets the updated requirements to the specifications as stated on page 1 of this Addendum.
Q: Jerr-Dan is no longer making the 8.5 Ton XLP Carrier with a steel deck and dimensions of 24' x 102". While we have two of these bodies sitting on our lot, these can no longer be ordered direct from Jerr-Dan. Would a similar model of XLP carrier be acceptable for this solicitation?
A: Does not need to be Jerr-Dan specific but it is critical that it has removable rails.
Q: Do you need 48 inch tool boxes or 60 inch tool boxes A: DPS prefers to have the maximum possible amount of storage for tools. If 48 and 60 are the only two options, then we would like the 60 inch tool box.
Q: When does the vehicle need to be delivered to Texas DPS, ready for use?
A: Yes, this should be a turnkey product. It should be immediately ready for DPS use.
Q: Can you please confirm the year of the wrecker truck you need?
A: Model year should be 2026 or later.
