About this file
This is an Execution of Offer form for Request for Offer (RFO) No. 601320000068627 issued by the Texas Department of Transportation (TxDOT). The document serves as the formal certification and authorization document that respondents must complete and return with their proposal submission. Failure to return the signed Execution of Offer will result in the response being deemed non-responsive. The form requires the responding entity to certify the accuracy and completeness of all submitted information, confirm that no improper inducements or anti-competitive communications have occurred, and authorize an individual to execute the offer on behalf of the respondent.
The document contains multiple statutory compliance certifications required under Texas Government Code and federal law, including verification that respondents are not debarred or suspended from federal procurement, have not violated anti-trust laws, do not have conflicts of interest with state agency personnel, and are not listed on terrorism watch lists or OFAC's Specially Designated National list. Respondents must also authorize the State Auditor to conduct audits of funds received directly or indirectly through subcontracts and agree that any payments may be applied toward debts owed to Texas, including delinquent taxes and child support. The form includes optional preference claims under Texas Administrative Code Rule 34TAC 20.306 across multiple categories, including Texas resident and product preferences, economically disadvantaged business preferences, service-disabled veteran ownership, air quality standards, recycled materials, energy efficiency, and nutritional value specifications.
