About this file
This is Addendum Number 1 to a Request for Proposal (RFP) issued by the Texas Commission on Environmental Quality (TCEQ) for air quality monitoring services at multiple sites in the Harlingen area under solicitation number 582-27-00014. The solicitation seeks services for continuous ambient air data collection and monitoring at five locations: Mission, Brownsville East 6th Street, Harlingen Teege, Isla Blanca State Park Road, and Edinburg East Freddy Gonzalez Drive. Services include operation of various monitoring equipment such as PM2.5 monitors, PM10 monitors, ozone analyzers, volatile organic compound canister samplers, and meteorological sensors. Key deliverables include monthly verifications, quarterly calibrations and audits, eight liquid calibration checks annually, preventive maintenance, demonstration of competency for all operators, inventory management, site maintenance verification, and invoice submission. The deadline for written questions is March 17, 2026, at 3:00 PM Central Time, and proposals must be submitted by April 2, 2026, at 3:00 PM Central Time via TCEQ's secure file transfer protocol server as a single searchable PDF file with a separate Excel price form. A pre-proposal conference was held on March 10, 2026, with presentations and an attendee roster included as exhibits.
Evaluation of proposals will be based on a maximum of 101 points distributed across six criteria: Executive Summary (5 points), Demonstrated Ability to Perform (30 points), References (1 point), Commitment of Qualified Personnel (15 points), Technical Approach (30 points), and Cost to Perform the Service (20 points). Respondents must submit a Historically Underutilized Business (HUB) Subcontracting Plan, as TCEQ has established a 1.0% HUB utilization goal for Professional Services and Other Services categories. Responses without a completed HUB Subcontracting Plan will be rejected as materially non-compliant. The HUB Subcontracting Plan courtesy review deadline is March 20, 2026, at 12:00 PM. Respondents must review the sample contract terms and conditions provided and submit any objections or exceptions with their proposals under the appropriate tab. All proposals and addenda must be signed and dated before submission. Respondents must also certify compliance with Executive Order GA-48 regarding prohibited technologies and foreign ownership restrictions.

• Please review the Terms and Conditions and the Insurance
Requirements in the draft contract documents section of the solicitation.
• If you have any objection to the terms or insurance requirements, please note this in your response under the appropriate TAB.
• Please be specific and avoid vague statements such as “We wish to negotiate if awarded the contract”.
• TCEQ may, in certain situations, consider negotiating terms.
• Do not object to all the terms.
• Some terms cannot be negotiated because they are required by law.
Legal Considerations 3 Latest Certification Changes
• EO GA-48 requires responders to it nor subsidiaries are:

• Listed in Section 1260H of the 2021 NDAA;
• Owned by the government of a country on the U.S. Department of
Commerce's foreign adversaries list under 15 C.F.R. § 791.4; or

• Prohibited Technologies
• *This is not intended to be a complete list*
Legal Considerations 4
Confidential Information
• The Texas Public Information Act is liberally interpreted by the courts to allow for the disclosure of any information regarding the expenditure of state funds.
• If a responder includes any information that it considers confidential or proprietary, it must label each and every page containing that information as confidential and proprietary and place that information behind TAB Confidential Information.
• Please do not mark every page of your proposal as proprietary and confidential. It is extremely unlikely that the Attorney General, or any court will find your entire proposal as proprietary and/or confidential.
Legal Considerations 5
Confidential Information
• If TCEQ receives a request for information in your proposal that is marked as proprietary and/or confidential, TCEQ will make an effort to notify you that a Public Information Request was made for the information. TCEQ will notify the Attorney General that information was requested that was marked by a third party as Proprietary and/or Confidential.
• If you want to prevent disclosure of information that is subject to a PIR request, you must make arguments to the Texas Attorney General as to why the information is proprietary and confidential.
