About this file

This is a Performance Bond and Payment Bond form template issued by the State of Texas acting through the Board of Regents of The Texas State University System. The document serves as a surety bond requirement for contractors entering into contracts with the state university system. The bonds are designed to ensure faithful performance of contract obligations and timely payment to all laborers, materialmen, and suppliers involved in project execution. The form is a standardized template that requires completion with specific contract details including the principal contractor name and address, surety name and address, penal sum amounts, project name, project number, solicitation number, contract date, and campus location. The bond references Section 2253.021 of the Texas Government Code as the statutory authority for the requirement.

The performance bond obligates the surety to assume completion of the contract within fifteen days of the state's declaration of default by the principal contractor, with the surety's liability capped at the bond's penalty amount. The payment bond protects all claimants supplying labor, materials, or supplies and grants them direct rights of action against the bond. Both bonds stipulate that sureties must hold certificates of authority from the United States Secretary of the Treasury when bond amounts exceed $100,000, or alternatively provide evidence of reinsurance by a qualified reinsurer. Venue for any legal action is established in Travis County. The forms require execution with corporate seals and authorized signatures from both the principal contractor and surety, along with identification of the surety's home office agent or servicing agent including name, title, address, and telephone number.
