About this file

This is an Artificial Intelligence (AI) requirement attachment for a Texas Department of Transportation (TxDOT) solicitation (No. 601440000051803). The document establishes comprehensive requirements for vendors delivering technology solutions and/or services that incorporate AI functionality. Vendors must provide detailed explanations of all AI used—whether proprietary or publicly available—including specific actions and outputs generated, descriptions of AI recommendations and decisions, how AI functionality integrates within solutions, and clarification on whether AI components are optional or mandatory. Additionally, vendors must disclose information regarding Human-in-the-Loop (HITL) involvement, types and classifications of data utilized by AI systems, data handling procedures, and measures to mitigate biases and hallucinations. Vendors must also assess the reliability of deployed AI algorithms and models and outline strategies for managing unexpected inputs and edge cases.

During the contract term, vendors must notify TxDOT a minimum of 45 days prior to implementing any new AI functionality or changes to existing AI systems to ensure compliance with TxDOT's Acceptable Artificial Intelligence policy. TxDOT reserves the right to cancel the contract without penalty if any AI functionality fails to comply with established policies. The document provides specific definitions of key terms including Artificial Intelligence, AI Systems, Information Resources Technologies, Human-in-the-Loop decision-making, and TxDOT Data as classified under TxDOT's Data Classification Policy, establishing the framework for acceptable AI implementation within state contracts.

Attachment A - Artificial Intelligence Solicitation No. 601440000051803

1 – 2

1. Artificial Intelligence (AI):

1.1. Vendor must provide a detailed explanation of all AI, whether proprietary or publicly available, that may be used in the delivery of technology solutions and/or services.

This explanation must include, but is not limited to, the following:

1.1.1. The specific actions and outputs generated by the AI (decisions/output).

1.1.2. A description of what the AI functionality recommends, decides, documents, reports, or affects when deployed.

1.1.3. An overview of how the AI functionality is utilized within the solution.

1.1.4. Clarification on whether the AI functionality is optional or mandatory.

1.1.5. Information on the presence of Human-in-the-loop (HITL) involvement.

1.1.6. The types of data being utilized by the AI.

1.1.7. The classification and categorization of the data being used.

1.1.8. Details on the handling of data, including if it is being transferred outside of TxDOT, used to train an AI model, etc.

1.1.9. Measures taken to mitigate biases and hallucinations within the AI model.

1.1.10. An assessment of the reliability of the AI algorithms and models deployed.

1.1.11. Strategies for handling unexpected inputs and edge cases.

1.2. During the term of the contract, if any changes occur where new AI will be introduced, or the AI functionality originally submitted by the vendor will change. The vendor must send notification a minimum of 45 days prior to implementing any changes to existing or new AI functionality to TxDOT for review by TxDOT to ensure compliance with TxDOT’s policy for Acceptable Artificial Intelligence. TxDOT reserves right to cancel the contract without penalty if any AI functionality will not comply with TxDOT’s policy for Acceptable Artificial Intelligence.

1.3. AI is defined as:

1.3.1. Artificial Intelligence (AI) – A machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments.

2 – 2

1.3.2. Artificial Intelligence (AI) System– Any application that contains an AI component regardless of size or usage.

1.3.3. Information Resources Technologies (IRT) – Data processing and telecommunications hardware, software, services, supplies, personnel, facility resources, maintenance, and training. [Source: Texas Government Code, Chapter 2054.003]

1.3.4. Human-in-the-Loop (HITL) decision making - Human-in-the-loop decision making involves a human decision-maker working in tandem with AI to improve decision making outcomes. In HITL systems, the AI system provides input, recommendations, or predictions that the human decision-maker evaluates and approves or rejects.

1.3.5. TxDOT Data – As defined by TxDOT Data Classification Policy, is information that is written, produced, collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business:

1.3.5.1. by TxDOT;

1.3.5.2. for TxDOT where TxDOT owns the information, has the right of access to the information, or spends or contributes public money for the purpose of writing, producing, collecting assembling, or maintaining the information; or

1.3.5.3. By an officer or employee of TxDOT in the officer or employee’s official capacity and pertains to official business of the government body.

1.3.5.4. has context menu.
