About this file
This document contains special terms and conditions for an insurance agreement between a vendor and the Texas Commission on Environmental Quality (TCEQ). The terms establish mandatory insurance requirements for vendors, their employees, agents, and subcontractors who will be performing work on premises occupied or controlled by TCEQ. The vendor must maintain commercial general liability insurance within reasonable limits and workers' compensation coverage for all employees performing contract work on TCEQ premises, either through traditional insurance policies or qualified self-insurance programs as permitted by law.
The insurance policies must include specific protective provisions for TCEQ, designating the agency and its officers and employees as additional insureds on the Commercial General Liability Insurance policy. Additionally, the policies must contain a waiver of subrogation clause in favor of TCEQ, its officers, and employees for bodily injury including death, property damage, or any other loss arising from the contract performance. These requirements ensure that TCEQ maintains adequate protection and recourse in the event of claims or losses occurring during vendor performance of contractual obligations.
