About this file

This is Addendum No. 4 to an Invitation for Bids (IFB) No. 304T-26-265A1 issued by the Texas Comptroller of Public Accounts (CPA) Statewide Procurement Division for upholstery materials, specifically panel fabric vertical surface textiles in multiple colors for the Texas Department of Criminal Justice. The addendum modifies Part A specifications and provides clarifications through a questions and answers section. The procurement originally required bidding on 17 color line items but has been modified to require bidding on 16 mandatory colors, with Line 17 (Oatmeal) now optional. Fabric specifications must meet strict standards including 100% post-consumer recycled polyester fiber content, colorfastness testing per AATCC 16.3 Option 3 Grade 4 minimum, compliance with State of California Technical Bulletin 117 Section E flammability standards, and certification that products pass AB2998 and are compliant without fire retardant chemicals. The initial IFB response due date was November 19, 2025 at 1:30 PM Central Time, with a pre-bid conference held on November 4, 2025 and a questions submission deadline of November 7, 2025. The contract term runs from January 1, 2026 through December 31, 2026, with four potential renewal options extending through January 1, 2030. Referenced manufacturers include C.F. Stinson "Genesis" and Mayer Fabrics "Equal" or CPA-approved equivalents.

The addendum clarifies that tariff surcharges may be discussed with the Contract Management section after award and that fabric inspection must occur prior to cutting. The restocking fee language was modified to remove the specific 10% cap, allowing CPA and the customer to jointly determine justifiable restocking charges for returned compliant goods, though no restocking fees apply to orders cancelled prior to shipment. Cleaning code specifications were expanded to provide detailed guidance on water-based and solvent cleaning procedures, including prohibitions on carbon tetrachloride and other toxic chemicals. Vendors are informed that the Statewide Procurement Division does not conduct formal bid openings with oral bid readings or vendor attendance, but bid tabulations become available after contract award through the Comptroller's Open Records portal. All solicitation documents are posted on the ESBD website at https://www.txsmartbuy.gov/esbd/304T-26-265A1.

Questions and Answers IFB No. 304T-26-265A1 Title:

Question No. Question Answer

1.Fabric Polyester, Panel
a.Fiber Content: 100% Polyester

This should be: 100% POST CONSUMER RECYCLED, otherwise it is not the EQUAL Pattern from Mayer, nor is it GENSIS from CF STINSON; anything made from simply 100% Polyester will not comply with the original specifications for this product and will not meet the specifications.

This change is approved, see Addendum number 4, Part A Changes, number 1.

(4) Colorfastness to Light:

b. AATCC 16

This should be: AATCC 16.3, Option 3 Grade 4 min.

This change is approved, see Addendum number 4, Part A Changes, number 2.

(6) Cleaning Code: Water-Based Stains

This should read as follows: Clean with Water-based cleaning agents, foam, or pure water free solvents. Vacuuming or light brushing is recommended to prevent dust and soil build up. Also, Water/Solvent Cleaner – Spot clean with Mild Solvent, an upholstery shampoo, or the foam from a mild detergent.

Avoid any product that contains carbon tetrachloride or other toxic materials/chemicals. Pretest a small area before proceeding. Always rinse promptly with clean water.

This change is approved, see Addendum number 4, Part A Changes, number 3.

(7) Flammability:

(c) State of California Technical Bulletin 117

This has been updated to CAL 117, Section E to be current.

Bid should add this requirement: Passes AB2998 and is COMPLIANT (Prohibits FR or Fire Retardant chemicals)

This change is approved, see Addendum number 4, Part A Changes, number 4.

A.5.4 Tariffs Page A8 As you know these can change almost monthly. I am assuming CPA is willing to work with vendors on these rapid changes. I am NOT saying we will change them monthly, just trying to be transparent on the topic.

Tariff surcharges can be discussed with the Statewide Procurement Division Contract Management after award.

A.7.8 Warranty/Guarantee Page A15 All fabrics should be fully inspected prior to cutting. If fabric is cut, then identified to have a flaw, damaged, etc, it is hard to facilitate a claim. Should this be address in the solicitation?

Per Part A, Section A.8.8 Compliant Products, the Customer will inspect goods upon delivery. If delivered goods are found to be noncompliant, the Customer reserves the right to reject delivery.

A.9 Return, Cancellation and Restocking Fee Page 18 The Industry Average is between 25-35%, not 10% as written in the solicitation. At only 10% this exposes a vendor to a potential to be placed in jeopardy on an extremely large order, say thousands of yards the vendor would not have ordered otherwise. Mayer Fabrics would like to see this % at minimum of 25%, or perhaps even 30%.
