About this file

This document constitutes the Terms and Conditions for bids submitted to the Texas Department of Criminal Justice (TDCJ). The terms and conditions establish bidding requirements, specifications, delivery conditions, inspection protocols, and award criteria applicable to all state and local contract opportunities with TDCJ. Bidders must comply with all applicable rules, regulations, and statutes governing procurement in Texas and submit bids on the specified form with proper time-stamping and identification. Bids must be new, unused items meeting all OSHA standards and applicable regulations unless otherwise specified. Delivery shall occur during normal working hours within the timeframe specified in the solicitation, with the state reserving the right to make awards based on low line item bids, low total of items, or any combination serving the best interest of the state. The state reserves discretion to reject any or all bids, waive minor technicalities, extend contract terms up to three months, or award multiple vendors. Award decisions follow 34 TAC Rules 20.207(c)(2) and 20.306 and consider factors including price, bidder performance history, quality and specification conformance, and other best value factors as indicated.

Pricing terms require submission of F.O.B. destination, freight prepaid and allowed pricing unless otherwise specified within the solicitation. No substitutions are permitted without written approval from TDCJ Contracts and Procurement Department, and all goods are subject to inspection and testing by authorized TDCJ personnel. Payment shall be made thirty calendar days after receipt of the invoice, receipt of goods and services, and confirmation that delivery dates and specifications have been met per Texas Government Code Chapter 2251. Bidders must provide valid payee identification numbers and comply with E-Verify system requirements, accessibility standards per TAC Chapter 213, and various state certifications addressing suspension and debarment status, child support compliance, involvement in criminal activities, conflict of interest disclosures, and compliance with state purchasing policies. The state is not bound by oral statements or representations contrary to written specifications and reserves the right to audit all contract performance. Force majeure provisions apply, and any disputes shall be resolved through established procedures outlined in Texas Administrative Code Rule 155.31.
