SECTION II
PROJECT REQUIREMENTS
2.1 PROJECT SCOPE.
In accordance with the provision of the Texas Government Code, Chapter 2269, Subchapter G, Design-Build Method (DB), and Rules and Procedures, THC is soliciting qualifications to select a Design-Build Firm (DBF) for the above referenced project.
The selected DBF is to assist the Texas Historical Commission with design, cost estimating, materials selection, constructability, and value engineering during the pre-construction phase and provide construction services for the project.
For consideration of the solicitation, the total budget is $4,175,00.00; that will include fees for preconstruction phase services, construction phase services, construction general conditions, and all construction costs to reach project completion.
Perched on a bluff overlooking the Colorado River, Kreische Brewery and Monument Hill State Historic Sites share the stories of how Texans built Texas – a product of immigration, ingenuity, enterprise, risk, and sacrifice. The sites commemorate the historic Monument Hill is a memorial to the men who died in the Dawson and Mier expeditions.
In the mid-1800s, German immigrant Heinrich Kreische built his home and a commercial brewery atop this same bluff, becoming a prominent local entrepreneur. Visitors today can explore the ruins of Kreische’s brewery, see the rooms in the family’s stone house, and reflect at the Monument Hill tomb, all while enjoying sweeping views of the river valley.
The proposed project at Kreische Brewery and Monument Hill State Historic Sites include the construction of two new buildings—a ±3,000 square foot Visitor Center and a ±7,000 square foot Education Center—along with associated utilities, pathways/trails, and parking improvements. These new structures will greatly enhance the sites’ abilities to serve visitors, deliver interpretive programming, support educational initiatives, host events, and accommodate future growth.
The Texas Historical Commission (THC) has not developed any architectural drawings or design documents at this time.
However, THC staff will work closely with the selected Design-Build Contractor throughout the design process to define the project’s character and ensure the outcome reflects the historic integrity and natural setting of the sites. THC envisions this as a collaborative effort that will evolve during the design phase.
While there are no pre-developed schematics, THC has internally identified key goals for the project, including:
• Placement and orientation sensitive to the historic and topographic context;
• Appropriate visitor and staff circulation;
• Integration of indoor and outdoor educational space;
• Capacity to host school groups and public events;
• Modern accessibility and life-safety systems;
• Use of sustainable and maintainable materials.
The Visitor Center is intended to include an orientation space, interpretive exhibit space, staff offices, public restrooms, and a retail area. It will serve as the primary welcome point for guests and must be designed for high visibility and efficient visitor flow.
The larger Education Center is envisioned as a flexible facility capable of hosting school groups, workshops, lectures, and community events. It may include a large event space/multi-use area, storage, a prep kitchen, as well as support spaces such as restrooms and administrative rooms.
2.2 SCOPE OF SERVICES.
The Design-Build Contractor will be responsible for:
• Developing site-specific architectural and engineering designs based on THC input;
• Conducting all necessary code and permitting research;
• Ensuring that all structures comply with applicable building codes and accessibility requirements;
• Addressing functionality, aesthetics, budget, and constructability throughout the design and construction phases;
• Coordinating inspections and certifications for all safety systems.
Final building specifications—including structure type, finishes, systems, and layout—will be determined during the collaborative design process with THC staff, with an emphasis on honoring the sites’ cultural significance while meeting the practical needs of modern public use.
2.3 PERFORMANCE TRACKING.
THC will monitor the performance of the Contract issued under this RFQ. All services under the Contract shall be performed at an acceptable quality level. All deliverables will be submitted in accordance with the timeline agreed upon at contract signing.
2.4 SUBCONSULTANTS (if applicable).
Subconsultants may be needed to provide specialized services under the Contract related to the project and can be engaged with the prior review of qualifications and approval of THC. A/E must provide statements from each of its subconsultants, signed by an individual authorized to legally obligate each subconsultant, attesting to the fact that it will provide services as represented in the RFQ. No subconsultant under the Contract shall relieve Respondent of responsibility for ensuring the requested services are provided. Subconsultant may be required to submit ownership information similar to that required of A/E. A/E must disclose, at THC’s request, any information regarding subconsultant.
2.5 SUBCONTRACTORS.
Subcontractors providing services under the Contract shall meet the same requirements and level of experience as required of the Respondent. No subcontract under the Contract shall relieve the Respondent of responsibility for ensuring the requested services are provided. Respondents planning to subcontract all or a portion of the work to be performed shall identify the proposed subcontractors, and the response shall include a letter from each proposed subcontractor agreeing to work on the team.
2.6 HUB SUBCONTRACTING.
In accordance with the Texas Government Code, Sections 2161.181- 182 and Title 34, Chapter 20, Subchapter B, §20.281- §20.298 of the Texas Administrative Code (TAC), the Texas Historical Commission (THC) shall make a good faith effort to utilize Historically Underutilized Businesses (HUBs) in contracts for all other services contracts.
A Good Faith Effort is required by vendors when completing the HUB Subcontracting Plan which demonstrates the Respondent has completed one of the following for the planned subcontracting needs:
A) Using strictly HUBs for all subcontracting needs, B) Meeting stated agency goal for HUB subcontracted needs using both HUB and Non-HUB vendors, C) Performing “Traditional Good Faith Effort” of notifying two minority/women trade organizations and soliciting bids from three HUBs for each subcontracting opportunity, and allowing seven business days for response, D) Self-Performing Contract (performing all work with own materials and labor), or E) Utilizing a Mentor Protégé relationship (a formal agreement that is recognized by the State of Texas Comptroller of Public Accounts). For a listing of Mentor Protégé agreements click on link:

• 21.1 percent for all building construction, including general contractors and operative builders’ contracts,
• 32.9 percent for all special trade construction contracts,
• 23.7 percent for professional services contracts,
• 26.0 percent for all other services contracts, and

2.7 REMEDIES, TIME DELAYS, SUSPENSION, AND SANCTIONS FOR FAILURE TO PERFORM:
Suspension If this Contract is suspended by THC prior to its expiration date, the reasonable monetary value of services properly performed by Contractor pursuant to this Contract prior to suspension shall be determined by THC and paid to Contractor as soon as reasonably possible. THC shall not be required to pay any standby hourly rates during a suspension of work.
Sanctions If the Contractor fails to provide the goods or services contracted for according to the provisions of the Contract, or fails to comply with any terms or conditions of the Contract, THC may, upon written notice of default to the Contractor, terminate all or any part of the Contract. Termination is not an exclusive remedy, but will be in addition to any other rights and remedies as provided in equity, by law or under the Contract. THC may exercise any other right, remedy, or privilege which may be available to it under applicable law of the state and any other applicable law or may proceed by appropriate court action to enforce the provisions of the Contract. The exercise of any of the foregoing remedies will not constitute a termination of the Contract unless THC notifies the Contractor in writing prior to the exercise of such remedy.
