About this file
The document is a Performance and Payment Bond form issued by the Board of Regents of The Texas State University System, designed to protect the State of Texas in a contract procurement process. The form includes two separate bonds: a Performance Bond and a Payment Bond, which are standard legal instruments that provide financial guarantees for a specific project. While the specific project details are left blank in this template, the bonds are structured to cover a project with a solicitation number starting with 758-, indicating a systematic procurement process for a Texas state university campus.
The bonds require the Principal (likely a contractor or vendor) and a Surety to guarantee performance and payment for labor and materials, with the State of Texas as the Obligee. The Performance Bond ensures the Principal will complete the contract according to specifications, while the Payment Bond ensures prompt payment to all suppliers and laborers. If the Principal defaults, the Surety is obligated to take over the contract within 15 days and is liable up to the bond's penalty amount. For bonds exceeding $100,000, the Surety must provide evidence of federal Treasury certification or reinsurance. The venue for any legal actions related to these bonds is specified as Travis County, Texas.
