About this file
This is Addendum No. 2 for RFP01-SLMO-25-198 issued by The Texas A&M University System Office of Procurement & HUB Program for Energy Consulting Services. The addendum provides clarifications through a Q&A format, addressing questions about the RFP which is due on February 4, 2025. The services requested include energy consulting services across various areas including project evaluation, feasibility studies, and conservation planning. The A&M System indicates it may make multiple awards within the same areas of expertise, with specific project assignments to be determined according to section 3.3 of the RFP. The scope is specifically for consulting services only, not owner's representative services, and will only involve projects on A&M System owned land.
The addendum clarifies several key operational aspects: respondents must provide their own file sharing solution for proposal submission, all awarded vendors must maintain full insurance coverage as specified in Exhibit C, and the A&M System will own deliverables produced but not any patents or trademarks not already owned by them. The document also addresses questions about legal advisory services (indicating no direct law firm engagement), potential ineligibility for future project solicitations (to be determined based on specific engagement scope), and priority commitment requirements (noting only a general expectation of top priority service if selected).

ADDENDUM NO. 2
Date: January 16, 2025
RFP Due Date: February 4, 2025
RE: RFP01-SLMO-25-198 – Energy Consulting Services
Respondents shall acknowledge receipt of addendum(s) on the Execution of Offer (Exhibit A).
Questions/Responses:
1. Does TX A&M have a file share tool to share with respondents?
Response: No, A&M System does not have a tool established for Respondents to utilize. Each Respondent is responsible to find a file sharing tool (if needed for submission) to utilize and to share the required proposal response documents via email prior to the deadline.
2. How will multiple award vendors work for this RFP? Will multiple award vendors have a specific task or area of expertise they will individually handle or will the multiple award vendors compete after the award?
Response: The A&M System may award multiple Respondents within the same areas of expertise.
Refer to section 3.3 of the RFP for additional information regarding project assignments for specific work.
3. If several respondents are selected, will each respondent need to obtain and maintain the Insurance Requirements set forth in Exhibit C or will this be scaled to meet the percentage of work awarded?
Response: All Respondents, if awarded, must be able to provide the full coverage as stated on Exhibit C.
4. 3.1 Scope states "receive proposals from firms, experienced in reviewing, analyzing, and providing determinations of the best- value of proposed projects." 3.2 A - Services Required has several subsections (i-xv) using terms such as planning, development, design, assist, drafting contracts and stakeholder management and reporting which indicate a scope of work deviating from the 3.1 Scope statement. Please provide clarification of the work required for this RFP. For example: is TX A & M looking for an owner's representative on some projects?
Response: No, the A&M System is not looking for an owner’s representative. This RFP is only for consulting services.
5. 3.2 A 2 Land and resource feasibility studies - are these secured sites from A & M's real estate portfolio as indicated in section 3.2 B or will it included 'new' locations? Has A&M already identified projects for these sites for the energy consultants to evaluate?
Response: The services would only be needed for projects on A&M System owned land. No specific projects have been identified at this time.
6. 3.2 A 4 Energy consumption and conservation feasibility and planning -
Is the response intended to include specific energy saving strategy suggestions, or is it intended that respondents lay out a methodology for developing specific strategies?
Response: The scope of any individual project may include either of those services. For any specific project engagement, the full scope of services needed will be defined at that time.
7. 3.2 A 12 Legal Advisory Services - Respondent would typically work with its law firm to address any legal advice outside the scope of Respondent's technical expertise. Is the A&M System willing to engage a law firm either directly or as a subcontractor to Respondent to supplement legal advice outside the scope of Respondent's technical expertise?
Response: No. Refer to question #3 in Addendum #1 for additional information.
8. 3.4 Other Considerations If a Respondent is awarded an Agreement as a result of this RFP and are selected to assist the A&M System on a specific project which may generate revenues, reduce energy usage or resource depletion, create local grid stability, or provide backup energy resources for the A&M System, the Respondent may be ineligible to participate in any future solicitation for the development of that specific project. What is the A & M System criteria for determining whether or not a respondent is ineligible to participate in future solicitations?
Response: That would depend on the scope the Respondent is asked to provide on a specific engagement.
9. Ownership Of Created Works section of the Master Service Agreement- as written does this mean if we use a patent, trademark etc in the deliverable, it becomes TX A & M's property? It's very broad.
Response: The A&M System would own the deliverable, i.e. a report generated as the deliverable. It would not include ownership of any patent or trademark not already owned by A&M System.
10. Is there a publishing of the "Priority Commitment" available to respondents which outlines specifics that qualify for priority?
Response: In reference to the second paragraph of section 2.1 of the RFP, there are no specifics as this is just a general statement that if you are selected the A&M System would expect to be serviced as a top priority.
