About this file
This document is a Confidentiality Acknowledgment form for consultants of the Texas A&M University (TAMU) and the Texas A&M University System (TAMUS). The form outlines the consultant's responsibilities to protect and conserve public property, promptly disclose waste, fraud, abuse, and corruption, and safeguard any confidential or sensitive information related to their work with the Research Information Systems (RIS) department. The consultant agrees to keep the subject and outcome of such projects confidential, unless specifically approved by RIS Administration.
The related state and local contract opportunity is for the Maestro Evolution Refresh project, where the Texas A&M University System is seeking proposals from qualified firms to provide staff augmentation services for a like-for-like software refresh of the Maestro system, which is an enterprise-wide system that supports researchers and research administrators across the A&M System. The RIS department is managing the Maestro system.

As a consultant to the Texas A&M University (TAMU), part of the Texas A&M University System (TAMUS), you were given information relating to the Policies and Regulations of TAMU and TAMUS upon initial engagement. This notice is to serve as an additional acknowledgment of specific language contained within the following sections of TAMUS Policy 07.01 relating to Ethics.
TAMU and TAMUS consultants shall protect and conserve public property and shall not use it for other than authorized activities.
TAMU and TAMUS consultants shall promptly disclose waste, fraud, abuse, and corruption in accordance with System Policy 10.02, Fraud, Waste and Abuse, section 2.
It is a violation of state law for TAMU/TAMUS consultants acting with the intent to obtain a benefit or with intent to harm or defraud another, to intentionally or knowingly misuse any thing of value belonging to the government that comes into their custody or possession by virtue of their office or employment.
It is a violation of state law if a TAMU/TAMUS consultant, in reliance on information to which he or she has access in his or her official capacity and which has not been made public, (1) acquires or aids another to acquire a pecuniary interest in any property, transaction, or enterprise that may be affected by the information; or (2) speculates or aids another to speculate on the basis of the information. It is also a violation of state law if a TAMU/TAMUS employee, with the intent to obtain a benefit or with intent to harm or defraud another, discloses or uses information for a nongovernmental purpose that he or she has access to by means of his or her employment and that has not been made public.
I have read, understand, and agree to abide by the attached Ethics Policy for TAMU/TAMUS employees. I understand that release of any information designated as confidential and/or sensitive by Research Information Systems (RIS) to anyone other than my direct supervisors and those designated by RIS Administration to work on the project will be considered a violation. I further understand that this requires that I safeguard data in my care and ensure that it is not accessible by anyone other than my direct supervisors.
Furthermore, I understand that, although it may not be classified as confidential or proprietary or result in any pecuniary gain, RIS may be sensitive to the release of certain project related information, therefore, in exchange for the opportunity to work on projects with Research Information Systems, I agree to keep the subject and outcome of such projects confidential, unless specifically approved by RIS Administration.
Nothing in this agreement precludes the external consultant from using or disclosing generalized know-how, ideas, concepts, processes, information, or techniques related to the confidential information retained solely in intangible form in the unaided memory of the recipient.
