About this file
This document is a Supplemental Form 1 - Waiver Request for the Emissions Reduction Incentive Grants Program (ERIG) administered by the Texas Commission on Environmental Quality (TCEQ) under the Texas Emissions Reduction Plan (TERP). The form allows applicants to request a waiver of the ownership and usage requirements to replace and repower non-road or stationary equipment, marine vessels, and locomotives. Applicants must provide a detailed explanation of good cause for why the equipment being replaced does not meet the ownership and/or operation requirements, and how the replacement will result in projected NOX emissions reductions. Applicants purchasing third-party equipment must also complete additional sections to certify the equipment's operating history, condition, and suitability for replacement under the program.
The ERIG program provides financial incentives for repowering or replacing older equipment to reduce nitrogen oxides (NOX) emissions in nonattainment areas and affected counties in Texas. The program is established under the Texas Health and Safety Code and administered by TCEQ. Eligible applicants must submit the completed Supplemental Form 1, along with the Project Application Form, to apply for grants under this solicitation.

TCEQ may consider a request to waive one or more of the program requirements based on a finding of good cause.
• This may include short lapses in registration or operation due to economic conditions, seasonal work, or other circumstances.
• The burden is on the applicant to demonstrate why there is good cause to grant the waiver request.
Refer to Appendix C of the ERIG program Request for Grant Applications (RFGA) for TCEQ’s basis for determining good cause.
Applicants requesting a waiver to one or more of the program requirements must complete Part A of this form. Applicants who have purchased third-party equipment, or who plan to purchase third-party equipment from another entity for the purpose of replacing and disposing of the equipment under the ERIG Grant Program, must complete Parts A and B of this form.
Please complete a separate Supplemental Form 1 for each activity that includes a request to waive one or more of the program requirements and submit the completed form with the Project Application Form (TCEQ- 20965a/b/c).
