About this file

This document is Amendment No. 1 to Request for Proposal (RFP) 24-162 for Workplace Investigation Services issued by the City of Missouri City, Texas. The amendment answers several questions submitted by prospective bidders, including the date and time for public opening of sealed responses, the number of investigations performed by the City in the last three years, whether all work must be performed at the City's location, the length of the initial award, and the City's interest in additional workplace relations and employee relations services. The RFP seeks qualified firms to perform workplace investigations and confidential, neutral investigations on an "as-needed basis" for the City.

The amendment confirms that proposals must be submitted in hardcopy format and that electronic submission of investigation reports is preferred. It also clarifies that the City is seeking blended hourly rates for the provision of these services and that the City anticipates approximately 4 investigations per year. Additionally, the amendment states that the City will consider proposals from non-resident bidders who are registered to do business in Texas as foreign entities.

RFP 24-162

AMENDMENT NO. 1

REQUEST FOR PROPOSAL (“RFP”) 24-162

WORKPLACE INVESTIGATION SERVICES

August 1, 2024

The City of Missouri City Texas has issued this Amendment No. 1 to the above-referenced RFP for the purposes of answering the following questions submitted submitted in writing by the specified deadline:

Question 1: Is the date/time available for the public opening of the sealed responses?

(Page 8 of 9, Section 37)

Answer 1: See page 1 of the RFP.

Question 2: Can the City provide numbers of investigations performed during the last three

(3) years by year?

Answer 2: Approximately nine, not including investigations that were handled internally.

(2024-3 / 2023-1 / 2022 – 5)

Question 3: Of those investigations conducted in the last three (3) years, how many were outsourced by the City?

Answer 3: Approximately nine investigations were outsourced by the City.

Question 4: Is all work expected to be performed at the City’s location, including interviews, or may the selected party perform work, as needed and as approved by the City, virtually?

Answer 4: Generally, the location, including the location for interviews, may be selected by the party performing the work (including virtual interviews). The City may have a preference depending on the cost and efficiency of a certain location/mechanism for interviews. Certain investigations related to certain City departments may require onsite interviews.

Question 5: If all work is expected to be performed at the City’s location, does the City have the appropriate space to ensure interviews can be conducted in a neutral and private setting?

Answer 5: Not applicable. If on site interviews are need, the City staff assists the contractor with reserving the necessary space for interviews on site.

Question 6: What is the length of the initial award anticipated by the City?

Answer 6: One year with two additional one-year renewals.

Question 7: Scope of Services, number 3, states “If additional services, such as workplace relations services (i.e. complaint intake), are provided, describe them.” Can the City elaborate on what additional workplace relations services they are interested in? Would these services be solely related to workplace investigations? What services does the City use currently that they would be interested in the Proposer providing?

Answer 7: For workplace relations, the City would like for a vendor to complete the intake process which may include confirming a submission channel (via link/online form), complete initial contact with employee, review initial complaint/policy violation, ask preliminary questions that align with policy, complete intake form and document issues, initial fact-finding, follow-up with city contact/recommend action based on City policies. This process is currently provided by City staff.

Question 8: Scope of Services, number 5, states: “If employee services are provided, provide employee relations services including reporting and employer notification, for both civil Service (Texas Local Government Code Chapter 143) employees and non-civil service employees…” Can the City elaborate on what employee relations services they are interested in? Would these services be solely related to workplace investigations? What services does the City use currently that they would be interested in the Proposer providing?

Answer 8: For employee relations, the City would like for the vendor to provide intake services and close out services with complainants before the investigation and after the conclusion of the investigation.

Question 9: Is this RFP expected to require a 5 million excess umbrella policy as referenced in the sample consulting agreement?

Answer 9: The amount of the insurance is negotiable; consequently, submit a Certificate of Insurance (COI) with the other required documents specified in Section 38 Submittals.

Question 10: Please confirm that proposals must be submitted in hardcopy format i.e., sealed envelope/package must contain one (1) original document in a three-hole punch binder, and it should represent the proposer’s complete and professional response to this Solicitation… The sealed/package must also contain a flash drive with the requested information/response as one (1) complete pdf adobe document.

Answer 10: Confirmed.

Question 11: We understand the government may not award a governmental contract to a nonresident bidder. While our principal place of business is in Denver, CO, we are registered to do business in the state of Texas as a foreign entity and have one employee located in the state. Please advise if we are still eligible to submit a bid.

Answer 11: Yes.
