About this file

This document is a federal contract clause (ES7034) addressing the rework and repair of nonconforming material, dated January 2012.

The clause establishes definitions and procedures for two distinct processes: rework, which involves reprocessing nonconforming material to achieve complete conformance with drawings, specifications, and contract requirements; and repair, which reprocesses nonconforming material to reduce but not eliminate nonconformance, bringing items into a usable condition while acknowledging they will not fully comply with applicable requirements. Rework procedures and associated inspection procedures must be documented by the contractor and submitted to the Government Quality Assurance Representative (QAR) for review prior to implementation, with procedures subject to QAR disapproval. Repair procedures must be formally documented on a DD Form 1694 (Request for Deviation/Waiver) and submitted to the Contracting Officer for written approval before implementation. Both repair and rework submissions must include a description of the cause of nonconformances and preventive actions taken or planned. Each procedure must include reinspection provisions that take precedence over Technical Data Package requirements and provide government assurance that reworked or repaired items meet reprocessing requirements. The rework and repair requirements apply as a supply chain flow-down requirement to contractors and their suppliers, vendors, and subcontractors.
