About this file

This is a Justification and Approval for Other Than Full and Open Competition document executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet Navy Expeditionary Medical Research requirements.

The acquisition involves a service contract for an Agilent ICP-MS instrument system consisting of four proprietary components: an SPS 4 Autosampler (serial number AU19096445), MS40 with AV Platinum and new oil-drain (serial number IT19315119), Agilent 7900 ICP-MS (serial number SG19344560), and PSC 6106T Chiller (serial number 1907-04550). The service plan must include parts, labor, overtime, and travel, with at least one preventative maintenance per year and all required software updates. The contracting officer has determined that an OEM service plan from Agilent is the only viable option because the entire system is proprietary and complex; third-party work would void manufacturer warranties, prevent software updates, and cause maintenance problems. Market research was conducted with Agilent Technologies, which provided a price quote. The statutory exception permitting this single-source acquisition is 10 U.S.C. 2304(c)(1) and FAR 13.106-1(b)(1) for acquisitions under $150K. The document was certified by Nathan Gargas (Lab Manager/Research Biologist, EHEL/NAMRU-D) on 23 March 2026, Dr. Karen Mumy (Director, EHEL/NAMRU-D) on 10 April 2026, and Contracting Officer Shama I. Carter on 4 June 2026. Points of contact are the Contracting Officers in the Material Management Department, reachable at usn.detrick.nmrc.mbx.mmdcontracts@health.mil.

Text2: Agilent Technologies was contacted and a price quote provided (attached to package). Mr. Gargas searched available literature via google search. Only the OEM was able to provide a service contract that met the government’s need.

In discussions with the manufacturer, Agilent, only they can perform the required work on this proprietary instrument. Any third party work would void any warranties express or implied. Only an OEM recognized service package will meet the government’s need.

Text4: It must be an OEM service plan, since the entire system is proprietary and any third party work will void the warranties with the company and could cause problems down the line for OEM maintenance. Third parties will not be able to support software updates.
