JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

41 U.S.C. 253(c) and 10 U.S.C. 2304(c)

In accordance with Federal Acquisition Regulation 13.106-1(b) (1), I hereby determine that ProStep PDF Generator 3D is required through a sole source procurement and competition is precluded for the reasons indicated below.

Please select the appropriate statutory authorities in accordance with FAR Part 6.302, Circumstance Permitting Other Than Full and Open Competition:

☒FAR 6.302-1 Only one responsible sources and no other supplies or services will satisfy agency requirements;

1. Identification of the Agency and the Contracting Activity This requirement is in support of the General Services Administration (GSA), PB ITS, 1800 F Street, NW, Suite 1400, Washington, D.C. 20405.

2. Nature and/or description of the action being approved Pursuant to the authority of the Competition In Contracting Act (CICA) as implemented by Federal

Acquisition Regulation (FAR) Subpart 6.302 and GSA Acquisition Manual (GSAM) 506.3 for justifying other than full and open competition, the GSA intends to award a contract to ProStep.

3. A description of the supplies or services required to meet the agency’s needs (including the estimate value)

This is for the procurement of the following: Software maintenance for 1 production license and 2 non-production licenses for ProStep PDF Generator 3D and for IFC Class 1 CAD-Translator for PROSTEP PDF Generator 3D, .

The IGE is $10,490.00

4. An identification of the statutory authority permitting other than full and open competition In accordance with 41 U.S.C. 253(c) and/or 10 U.S.C. 2304(c), GSA has determined that the procurement requires a sole source in order to satisfy the Agency’s need. Specifically, the basis for other than full and open competition is that GSA in accordance with FAR 6.302-1 Only one responsible sources and no other supplies or services will satisfy agency requirements

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited GSA evaluated 3 other similar products – PDF3D, Bluebeam, and Safe Software. We found that PDF3D and Bluebeam did not offer the desired 3D PDF conversion capabilities, and that Safe

Software is overly complicated. Therefore, when GSA planned the procurement of the Tetra 4D desktop software it now uses, it intended to also procure the compatible server tool from Tetra 4D.

In addition, Tetra4D was the only official carrier for the Adobe 3D PDF specification. Since the server tool is now a ProStep product, GSA must now procure the server tool from ProStep.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Including whether a notice was or will be publicized as required by Subpart

5.2 and, if not, which exception under 5.202 applies GSA conducted internet research for comparable tools and for vendors of ProStep in federal acquisition programs. See the attached Market Research and Source List. GSA did not find other sources from which to solicit additional offers.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable The following IGE $10,490.00 represents a fair and reasonable value to the government based on market research, historical procurement data, and/or specific industry knowledge by the technical representative.

8. A description of the market research conducted (see part 10) and the results or a statement of the reason market research was not conducted GSA conducted internet research for comparable tools and for vendors of ProStep in federal acquisition programs. See the attached Market Research and Source List.

9. Any other facts supporting the use of other than full and open competition N/A

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition Brian Schouten Brian.Schouten@prostep.com ProStep 300 Park Street, Suite 410 Birmingham, MI 48009

11. A statement of actions, if any, that agency may take to remove or overcome any barriers to competition before any subsequent for the supplies or services required N/A

***NOTE: If sole sourced procurements need to be recompeted in the future, Federal regulations prevent the Contracting Office from reprocuring these requirements through means of a sole source during the recompete.***

Program/Technical Official Certification:

I hereby certify and accept the responsibility that any and all supporting data provided above or used to justify the above requested for a sole source procurement (e.g., verifying the Government’s minimum needs, schedule requirements, and/or other rationale for other than full and open competition) is accurate and complete to the best of my personal knowledge and belief.
