Brand Name Justification FAR Subsections 6.302-1(c)
1. Identification of agency and contracting activity: The requiring activity is General Services Administration (GSA), Public Buildings Service (PBS), Region 10, Facilities Management Division, Environmental & Energy Branch. The contracting activity is GSA, PBS, Region 10, Acquisition Division, Construction Acquisition Branch (10PQC). The Contracting point of contact for this action is Kim Johnson, Contracting Officer, who can be reached at (253) 931-7337 or kimberlym.johnson@gsa.gov. The technical point of contact for this is Josh Doerr.
2. Nature and description of action being approved: The action being approved is a sole brand acquisition for KMC products. The vendors solicited for this project must be licensed /certified to install, configure, and program KMC products and in particular the KMC BAC 5901 devices at the building network identified below:
A. Nakamura Courthouse (WA0035ZZ) located Seattle, WA 98104-1195
3. Description of supplies or services required to meet the agency needs (including the estimated value): Region 10 requires a contractor with Building Automation Systems (BAS) technical expertise with KMC products to perform a system controls upgrade/replace KMC (BAS) devices currently controlling a cooling tower and multiple air handling units. Graphic packages must also be created and placed on the GSA R10 Niagara Virtual Server. After all work is completed the database for the whole network needs to be backed up to the Virtual Server and a hardware copy stored a Flash drive and delivered to the GSA Project Manager assigned to this contract.
4. An identification of the statutory authority permitting other than full and open competition.
This acquisition is being conducted under the authority of Title 41 U.S.C. 3304 subsection (a)(1), as implemented in Federal Acquisition Regulations (FAR) Subsection 6.302-1, allows for other than full and open competition when there is only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
The current Building Automation System platform installed at the location listed in Section 3 above is KMC Controls® Total Control System. KMC equipment and software is very technical in nature and requires highly qualified personnel that have received the necessary technical training and specialized software tools from KMC to insure proper operation, efficiency, and reliability of the Building Automation Systems.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202applies.
The Contracting Officer for this solicitation will post a combined synopsis/solicitation under FAR Part 13 to the GPE, FedBizOpps for a period of 14 business days. The Contracting Officer referred to the Regional KMC Vendor Contact list for Washington and identified (3) contractors that are eligible to receive government contracts and are authorized to work on the KMC equipment. In section 10, a list of interested vendors are known.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer will take sufficient measures to ensure the prices/costs proposed are fair and reasonable and render a determination of such in a Price Negotiation Memorandum (PNM). The PNM will capture the pricing environment, information relied upon, price/cost analysis conducted, findings, and basis for such determination, as well as documents the best value decision. The contracting officer will solicit comments from the appropriate PBS personnel and Subject Matter Expert (SME) regarding technical criteria listed RFQ and Pricing information including types and quantities of labor hours, reasonableness of the labor mix, and reasonableness of travel proposed. The contracting officer will evaluate Pricing in accordance with the RFQ, including verification the rates proposed by the Offeror.
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
Market search was conducted by both the GSA Technical and Contracting points-of-contacts (POC), with the Technical POC utilizing a local directory and internet search for all vendors that would be qualified to work on this equipment. His research yielded five (5) vendors, three of which are registered in SAM and are eligible to receive government contracts:

9. Any other facts supporting the justification: The existing controls system comprises end of life KMC products and this solicitation is to replace end of life controllers. This is the most cost effective solution to maintain and upgrade the current system in order to improve its functioning capabilities.
10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition
The following interested vendors were identified through the KMC controls authorized vendor list. All of the vendors listed are capable of providing the brand name equipment required for the proposal.

11. Statement of actions, if any, to remove or overcome any barriers to competition
Currently, there are no barriers to overcome or remove to promote and receive adequate competition for this acquisition.
