About this file
This is a pre-bid meeting handout from the County of San Bernardino Department of Public Works regarding the eProcurement Network (ePro) system and the Emerging Small Business Enterprise (ESBE) Program. The document outlines procedural requirements for bidders submitting proposals on County projects, including the Fontana Transportation Yard - Motorized Gate project. All bidders must register with the ePro system prior to the bid submission deadline or face disqualification. Sealed proposals are received and publicly opened via GoTo at the County Public Works office located at 825 Third Street, San Bernardino, California 92415 in the Contracts Division. Bidders must submit fully executed proposal documents, scan and attach certification pages for any addendums, and submit original bid security in hard copy format in a separate sealed envelope labeled "Bid Bond." Both the bid bond and bid must be received by the specified bid opening time. The Proposal Checklist and Assembly Sequence on page P-2 outlines necessary information for proper completion of the bid package, with failure to properly complete the package resulting in bid rejection.
The County's ESBE Program, established in 2000, encourages small business participation in County procurements as either prime or subcontractors but does not mandate small business utilization, impose subcontracting goals, or require tracking or reporting unless otherwise specified in project documents. Small businesses, Disadvantaged Business Enterprises (DBEs), and Disabled Veteran Business Enterprises (DVBEs) are encouraged to become certified with the California Department of Transportation (Caltrans) to increase visibility to prime contractors. The document also addresses AB219 requirements regarding prevailing wage compliance for ready-mixed concrete hauling and delivery on public works projects, including mandatory registration with the Department of Industrial Relations, certified payroll record submission, and written agreements specifying prevailing wage compliance. System-related issues should be directed to Vendor Support at Jillian.Cole@pur.sbcounty.gov or (909) 387-3373, while procurement questions should be directed to the Purchasing Department at (909) 387-2060.

Emerging Small Business Enterprise (ESBE) Program
History The San Bernardino County Board of Supervisors established the “Emerging Small Business Enterprise (ESBE) Program” in 2000 to encourage the participation of small businesses in County procurements and to insure that small business owners have the maximum opportunity to participate in County contracts as either prime or subcontractors.
Prime contractors are encouraged to make small business owners aware of subcontracting opportunities on public works projects. The County hopes that, through the process, the prime contractors may find that some small businesses can perform certain tasks more cost-effectively than they can, and would thus hire them to perform such tasks on public works projects.
Outreach Efforts If your company is either an Emerging Small Business Enterprise (ESBE), Disadvantaged Business Enterprise (DBE), or Disabled Veteran Business Enterprise (DVBE), you are encouraged to become certified as a small business with the California Department of Transportation (Caltrans). Businesses that are certified with Caltrans are listed in a database on the Caltrans web site, and can thus be easily located by prime contractors who want to use small businesses for subcontracting opportunities on public works projects in the state of California. Detailed instructions and requirements on how to become certified are found on the Caltrans web site, at: http://www.dot.ca.gov/obeo
Small businesses are encouraged to bid on the project. If you intend to participate in the project as a subcontractor, you can request a list of plan holders from the County of San Bernardino Department of Public Works, Contracts Division, located at ContractsDivInfo@dpw.sbcounty.gov, and contact those potential prime contractors who want to use small businesses for subcontracting opportunities.
If you are a prime contractor, you are encouraged to obtain the most current list of small businesses certified with Caltrans by accessing the DBE database, at:
http://www.dot.ca.gov/obeo
Program Compliance The County ESBE program is strictly an outreach program. Unless otherwise stated in the project documents, there is no goal, no percent of work that has to be performed by a small business, and no tracking or reporting requirements. The prime contractor is not mandated to use small businesses, only encouraged to.
AB219
AB219 expands the definition of public works under the California Prevailing Wage Law to include: the hauling and delivery of ready-mixed concrete to carry out a public works contract, with respect to contracts involving any state agency, including the California State University and the University of California, or any political subdivision of the state.
Section 1720.9 defines the term ready-mixed concrete and specifies that the rate of pay shall be the current prevailing wage "for the geographical area in which the factory or batching plant is located" as determined by the Department of Industrial Relations. The statute also requires a written agreement between the party hauling or delivering ready-mixed concrete and the party that engages its services. The agreement must specify compliance with the Prevailing Wage Law.
Finally, section 1720.0 requires that the hauling or delivery company provide certified payroll records under Labor Code section 1776(a) to the party that engages its services and to the general contractor within five working days after the employee has been paid, accompanied by a written time record. The time record must be certified by each driver for the performance of job duties.
Ready-mix haulers and companies that deliver ready-mixed concrete for public works projects are considered subcontractors under Labor Code section 1722.1 and must register with the Department of Industrial Relations as specified in Labor Code section 1725.5. A Contractors’ State License Board license is not required to register with the DIR or to work on a public works project (contractors working in a trade that is subject to licensing by the CSLB will still be subject to CSLB licensing requirements).
Suppliers and other trucking companies will need to provide a Public Utilities
Commission license number, U.S. Department of Transportation license number, and any other state or federal license, if one is required for your business. If none of these apply, the supplier can register with the DIR by selecting other in the license type menu and entering N/A for not applicable in the license number field.
