About this file
This document is a Question and Answer record from a pre-proposal meeting for Construction Management Services related to Long Beach Utilities' Large Potable Water Valve Replacement Project on Willow Street (EO-3598, WD-52-22). The project involves the replacement of a large potable water valve, and the construction management services scope includes multiple subtasks, notably Subtask No. 5 concerning Concrete, Geotechnical, and Soil Testing. The pre-proposal meeting addressed clarifications regarding consultant and contractor responsibilities, particularly regarding soil contamination testing and hazardous materials handling. The document reflects inquiries from potential proposers about the division of testing responsibilities, environmental subconsultant requirements, and the coordination procedures outlined in the contract specifications.
The key clarification provided by Long Beach Utilities addresses the distinction between contractor quality control testing and consultant quality assurance testing for contaminated soils. The owner confirmed that consultants are responsible for providing quality assurance testing independent of contractor quality control testing, with the consultant maintaining the ability to perform testing if the contractor fails to do so. The contract specifications allocate responsibility to the contractor for importing, backfilling, and disposing of contaminated soils through an optional allowance bid item, while requiring coordination with testing agencies recommended by the owner and a contaminated soil remediation specialist as needed. This Q&A clarification establishes that consultants must be capable of securing environmental subconsultants and testing laboratories to fulfill their quality assurance obligations under Subtask No. 5.

CONSTRUCTION MANAGEMENT SERVICES OF
LARGE POTABLE WATER VALVE REPLACEMENT PROJECT – WILLOW ST
(EO-3598)
WD-52-22
Question and Answers
1. Regarding Subconsultants and Consultants responsibilities for encountering contaminated soils:
Under Subtask No. 5 – Concrete / Geotechnical / Soil Testing, “The Subconsultant is required to provide testing for possible soil contamination.”
“If contaminated soils are encountered, provide guidance to ensure that the contractor handle and dispose of any hazardous materials per contract specs, safety, and environmental regulations.”
Under the Contract Specifications:
Section 01 22 00, Unit Prices, Part 3.20, Optional Bid Item No. 24 – Allowance to Excavate and Dispose of Contaminated Soils.
Contractor will be required to import, backfill, compact, transport costs, disposal costs, and other work necessary for removing contaminated soils and replacing with 1-sack slurry.
Under this Section, Contractor will be reimbursed if the Optional Allowance is used.
Under the Contract Specifications:
Section 01 35 44, Environmental Procedures for Hazardous Materials, Part 3.2, Contaminated Soils: Contractor is required to coordinate with testing agencies recommended by Owner (Consultant) to facilitate material testing.
Part 3.3.C.1, Contractor is required to coordinate removal of hazardous materials with
Owner’s contaminated soil remediation consultant/contractor (CSRC).
Part 3.4, Disposal of Hazardous Wastes, Contractor is required to legally dispose of, employ qualified testing laboratory to test for contamination.
Can you please clarify if Consultants are required to secure/provide Environmental Subconsultants and Special Testing Laboratory under Subtask No. 5?
There appears to be a duplicate responsibility between the Consultant and the Contractor for testing for soil contamination, please clarify?
The Subconsultant to “provide guidance” appears vague when it comes to responsibilities to secure / provide Environmental Subconsultants and Special Testing Facilities, please clarify?
ANSWER: The Contractor’s testing is for their quality control. The testing from the Consultant is quality assurance. We also want to have the ability to perform testing if the contractor does not perform.
