Board for entering this Agreement was and is the reputation and skill of Consultant's key employee ______________. The Board shall have the right to approve any person proposed by Consultant to replace that key employee.
4. INDEPENDENT CONTRACTOR. In performing its services, Consultant is and shall act as an independent contractor and not an employee, representative, or agent of the Board or City. Consultant shall have control of Consultant's work and the manner in which it is performed. Consultant shall be free to contract for similar services to be performed for others during this Agreement provided, however, that
