About this file
This is an Executive Order No. 16 Certification form required by the State of New York for all vendors responding to state contract solicitations. The certification addresses compliance with Executive Order No. 16, which prohibits New York State entities from entering into new contracts or renewing existing contracts with businesses conducting commercial operations in Russia. Vendors must certify their Russia business operations status by selecting one of four options: confirming no business operations in Russia, confirming operations while winding down, confirming operations limited to vital health and safety services or federal compliance, or confirming ongoing business operations in Russia. The form requires the vendor's legal entity name, authorized signature, signatory name and title, and certification date, with certification made under penalties of perjury regarding the accuracy and truthfulness of the submitted information.
The certification requirement applies to the Incarcerated Individual Transport Service solicitation for Orleans Correctional Facility in New York, which seeks a transport service provider to deliver work-release individuals to and from Rochester on a daily basis with no subcontracting permitted. The incumbent contractor is Transpo Bus Services. The procurement includes minority and women business enterprise contracting goals of 15 percent for MBE participation and zero percent for WBE participation, with no service-disabled veteran-owned business or disadvantaged business enterprise goals. While the Executive Order remains in effect during federal sanctions, vendors are encouraged to respond to preserve future contracting opportunities in the event sanctions are lifted during the solicitation or after award.
