About this file
This is an Emergency Purchase Statement filed by the Illinois Department of Agriculture, Bureau of Weights and Measures, for the procurement of two cab chassis vehicles from CIT Trucks LLC. The vehicles, specifically T880 Series Conventional models with 22-foot boxes and 40,000-pound rear axle loads, are designated for conducting large-capacity scale inspections required under the Illinois Weights and Measures Act. The emergency purchase was authorized on June 9, 2026, with an actual contract award date of June 10, 2026. No bid opportunity or competitive solicitation period was conducted due to the emergency circumstances and the compressed fiscal year-end timeline of less than three weeks.
The total expenditure for this emergency purchase is $451,500.00 in actual costs, funded through State Appropriated Funds. The emergency condition was justified by the need to prevent disruption to critical State services that support approximately $7 million in annual inspection fee revenue. The purchase became necessary after the previous contract with Arch Equipment (contract number 21-406AGR-PROC4-P-23438) was canceled on June 4, 2026, when the vendor failed to meet contractual specifications and refused to remediate deficiencies. CIT Trucks LLC was selected as the sole vendor capable of providing the specified vehicles within the compressed delivery timeline. The agency conducted searches for Business Enterprise Program (BEP) certified minority vendors but determined that available minority vendors only offered delivery services rather than manufacturing capabilities.

Emergency Condition (select the appropriate option from the drop-down menu below):
To prevent or minimize serious disruption in critical State services that affect health, safety, or collection of substantial State revenues
Provide a description and reasons for needing this emergency purchase:
Illinois Department of Agriculture-Bureau of Weights and Measures is seeking to purchase two large cab chassis, which will be used for the will be used to conduct large-capacity scale inspections required under the Illinois Weights and Measures Act (225 ILCS 470/10). These inspections are essential to ensuring the accuracy and compliance of commercial weighing devices throughout the State of Illinois. Inspection fees are charged with approximately $7 million in revenue received each year.
Revenue received from the inspection fees supports the operating costs of the Bureau. Any loss of productivity caused by vehicle issues results in a reduction in revenue by the loss of inspections performed as well as inability to meet the mandate of inspecting all commercial devices each year.
Provide the conditions and circumstances that led to the need for this emergency purchase:
In 2021, the Illinois Department through an IFB, sought to procure four large chassis trucks. Arch Equipment won the bid for the four large trucks , with the contract number 21-406AGR-PROC4-P-23438, which was canceled recently. Despite the clear specifications that the vendor bid on, when the vehicles were delivered , they were not up to the standards, based on the contract specifications. The quality of the first two trucks was low. Ranking on a grade from A to F, when those vehicles were delivered, they rank C-. They did not meet many specifications which were required on the contract. The department accepted those two trucks, since they still could be used and do perform the required minimum, however, for the third truck which was delivered recently, the department required from the vendor to equip the truck with all the required specifications. Despite multiple rounds of negotiations, involving even the legal team of the department, the vendor refused to meet all the required specifications, therefore the contract was canceled on 06/04/2026. As a result of the contract cancellation, the department is left with more than $ 450,000.00. Since the fiscal year is ending in less than three weeks, the Department is seeking to use these funds to purchase the cab chassis, so they can be used for the inspection.
Reason for selection of this particular vendor:
CIT Trucks LLC was selected because it was one of the only vendors that was able to provide the cab chassis during the lapse period, with all the required specifications. The department sought few vendors, however, only CIT Trucks was able to provide such specialized specifications, as required by the bureau.

Emergency procurements shall be made with as much competition as is practicable under the circumstances, and agencies shall utilize best efforts to include contractors certified under the Business Enterprise Program in its emergency procurement process. 30 ILCS 500/20-30(a).
Describe the actions taken by the agency to make the emergency purchase with as much competition as is practicable under the circumstances:
The agency did try to make this procurement as much as possible competitive, such as bidding it out through an IFB. However, the vendor was not responsible since they did not uphold to the specifications and they refused to correct their work, leaving the department with no choice, but to declare emergency with such a short time frame. Considering, that the vehicles will have to be delivered during the time lapse, CIT Trucks was the only vendor able to deliver in this short time frame.
List the actions taken by the agency that constitute its best efforts to include contractors certified under the Business Enterprise Program in this emergency purchase:
The agency did search for BEP vendors under NIGP code 071-08, however, the two minority vendors, do not produce trucks, they only deliver goods.
