About this file
This Emergency Purchase Statement details an emergency procurement by the State of Illinois Central Management Services (CMS) and the Chief Procurement Officer for General Services on behalf of the Illinois Department of Transportation (IDOT) to purchase bulk rock salt for the 2026-2027 contract year. The emergency procurement was initiated under BidBuy Reference B-53801 to serve 260 IDOT locations that did not receive quotes under the original competitive bid B-52513, which solicited quotes from 905 locations. The vendor, Midwest Salt, LLC, located in Springfield, Illinois, will provide and deliver bulk rock salt directly to each IDOT location as specified by CMS, with separate invoicing to each location based on actual quantities received. The emergency was classified as involving a threat to public health and public safety, with the purchase authorized and signed on August 31, 2026.
The estimated total expenditure for this emergency purchase is $12,247,079.40, with the amount designated as estimated pending submission of an Emergency Final Cost form within ten days of the succeeding month. The emergency purchase was deemed necessary due to limited rock salt supply caused by harsh winter conditions extending from the Midwest to the East Coast, combined with one of three major suppliers choosing not to submit a quote under the original bid, which prevented the remaining two suppliers from filling the void. CMS determined that Midwest Salt, LLC, an existing, registered, and certified State of Illinois vendor, could meet the immediate need with competitive pricing under current market conditions while avoiding further supply constraints or price increases from delayed procurement. Funding sources include federal funds, state appropriated funds, state grant funds, and other sources. CMS made best efforts to include Business Enterprise Program certified contractors by providing a vendor list for potential subcontracting opportunities, particularly for hauling services.

Emergency Condition (select the appropriate option from the drop-down menu below):
Involving threat to public health or public safety
Provide a description and reasons for needing this emergency purchase:
The purpose of this emergency is to establish a joint master master contract to enable the Illinois Department of Transportation (IDOT) locations that did not receive a quote under the original bid to purchase bulk rock salt for CY26-27.
Provide the conditions and circumstances that led to the need for this emergency purchase:
This procurement was previously bid under B-52513 for 905 locations. CMS did not receive a bid for 260 of the 905 locations. We usually have 3 major rock salt suppliers that submit quotes, but this year 1 of those suppliers chose not to submit a quote. This major supplier choosing to not submit a quote left a void in our bid, that the other two major suppliers could not fill. The other circumstance that is becoming apparent is that the supply of rock salt is and will be limited this year due to the harsh winter last season that spread from the Midwest all the way to the east coast.
Reason for selection of this particular vendor:
This vendor was selected because it is an existing, registered, and certified State of Illinois vendor that is qualified to provide the required rock salt. This vendor was able to meet the agency's immediate need for the required quantity within the necessary time-frame while offering pricing that was considered affordable under the current market conditions. Selecting an established State of Illinois vendor allowed CMS to secure the available supply promptly and avoid the risk of further supply constraints or increased pricing associated with delaying the purchase.
Description of supplies or services to be provided:
The vendor shall provide and deliver bulk rock salt directly to each IDOT location specified by CMS. Deliveries shall be made in accordance with the quantities and delivery requirements established for each location. The vendor shall invoice each IDOT location separately for its actual quantity received and corresponding share of the total cost of the rock salt supplied.
Emergency procurements shall be made with as much competition as is practicable under the circumstances, and agencies shall utilize best efforts to include contractors certified under the Business Enterprise Program in its emergency procurement process. 30 ILCS 500/20-30(a).
Describe the actions taken by the agency to make the emergency purchase with as much competition as is practicable under the circumstances:
CMS evaluated the availability of rock salt and determined that an immediate purchase was necessary to secure available supply while favorable pricing remained available. Given the limited availability of rock salt and the need to act quickly to maintain an adequate supply, CMS sought to obtain the material from an existing State of Illinois registered and certified vendor capable of meeting the agency's immediate needs. The agency considered the availability, price, and ability to provide the required quantity within the necessary time-frame in determining the source of the purchase. Due to the time-sensitive nature of the market and the risk that the available supply and pricing could be lost if the agency delayed procurement for a traditional competitive solicitation, CMS determined that the emergency purchase represented as much competition as was practicable under the circumstances.
