About this file

This is an Emergency Purchase Extension Approval document from the State of Illinois Chief Procurement Office for General Services involving the Illinois Commerce Commission (ICC). The document details an extension for court reporting services provided by Deposition Solutions LLC dba Lexitas, with the original emergency contract running from June 18, 2025, to September 15, 2025, and the proposed extension period from September 16, 2025, to January 31, 2026. The ICC requires these services to fulfill statutory requirements under Section 10-102 of the Illinois Public Utilities Act, which mandates verbatim transcription of Commission meetings and hearings by a certified court reporter.

The extension contract is valued at $50,000, bringing the total contract value to $160,000. The ICC is currently working on a formal competitive bid (IFB) for these services and is also exploring the possibility of hiring full-time staff to handle court reporting internally. No Business Enterprise Program (BEP) participation is possible because no BEP-certified vendors currently hold the required court reporter certification. The emergency extension is necessary to ensure continuous compliance with legal requirements while the agency develops a long-term solution for court reporting services. The document indicates that multiple previous attempts to procure these services competitively have been unsuccessful, necessitating this emergency approach.

The Illinois Commerce Commission is mandated under 220 ILCS 5/10-102 and 83 Ill. Adm. Code 200.580 to use a certified court reporter for all hearings. A review of the Illinois Department of Financial and Professional Regulation’s roster of certified court reporters and the CMS BEP Vendor Directory confirmed that no BEP-certified vendors currently hold the required certification. Because this credential is mandatory and no BEP-certified vendor is eligible to perform the work, a BEP goal cannot be set for this procurement.

1. Provide detail about the events that led the agency to conduct an emergency procurement:

The ICC previously executed a small purchase contract for court reporting services. Prior to this the agency has used the CMS master contract.
