UNICOR's desired delivery is fifteen (15) days or sooner after issuance of each delivery order. Vendors are required to provide their best manufacturing/delivery time for evaluation, and delivery schedule will be established at time of award.

Delivery orders will be issued in accordance with 52.216-19.

Vendors shall submit signed and dated offers via email to Karen.Hodge2@usdoj.gov and Tiffani.Balestrini.usdoj.gov. Due to security considerations, do not send offers via U.S. mail.

PART I: INFORMATION

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. The solicitation number is EL1038-23 and this solicitation is issued as a Request For Proposals (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-04. The North American Industry Classification System code is 444240. This requirement is unrestricted.

UNICOR, Federal Prison Industries, Inc., intends to enter into a 3-year, firm-fixed-price, indefinite delivery-indefinite quantity contract for the following commercial item(s):

OFFER ON ALL ITEMS MAY PREVENT AN OFFER FROM BEING CONSIDERED FOR

AWARD.

Any contract resulting from this solicitation will not be an obligation. Funds will be obligated by delivery orders.

NOTICE TO GOVERNMENT WHEN CONTRACTOR(S) DELAYS:

In the event the contractor(s) encounter difficulty in meeting performance requirements, or when there is an anticipated difficulty in complying with the delivery terms or completion dates, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely delivery/performance of this contract, the contractor must immediately notify the Field Administrative Contracting Officers at UNICOR Lompoc, CA with pertinent details. This information will not be construed as a waiver by the Government of the required delivery schedule, or the Governments rights to impose consideration against delinquencies or other remedies provided by this contract.

BEST COMMERCIAL CUSTOMER CATEGORY:

Contractor agrees that FPI is in the category of the most favored or best commercial customer category of the Contractor and as such, the Contractor will:

During the contract period, the Contractor shall report to the Contracting Officer all price reductions offered to the category of customers that are considered by the Contractor to be their most favored or best commercial customer.

1. A price reduction shall apply to purchases under this contract if, after the award date, the Contractor-

i) Revises downward its commercial catalog, price list, schedule, etc., to its best commercial customers (or category of customers) below the awarded price under this contract;

ii) Grants more favorable discounts or terms and conditions to its best commercial customers than those contained in this contract that would result in prices below the awarded price under this contract, an/or

iii) Grants special discounts to its best commercial customer (or category of customers) that would result in prices lower than the awarded price under this contract.

2. The Contractor shall offer the price reduction to FPI with the same effective date, and for the same time period, as extended to the commercial customer (or category of customers).

The Contractor may offer the Contracting Officer a voluntary price reduction at any time during the contract period.

The Contractor shall notify the Contracting Officer of any price reduction subject to this clause as soon as possible, but not later than 15 calendar days after its effective date.

Future requirements for these or similar items from this or other UNICOR factories may be added to the resulting contract if considered to fall within the scope of work and the price is determined to be fair and reasonable.

CONTRACTOR’S RESPONSIBILITY: It is the responsibility of the Contractor to follow any Special Security Requirements of the facility where the work is performed in the performance of the contract and to consider the effects of those security requirements in the pricing of the proposal.

WAGE DETERMINATION APPLICABLE TO THIS CONTRACT: The Service Contract Act (SCA) applies to this contract. The applicable SCA Wage Rate Determination is attached at the end of the contract text. Payment will be made to individuals used in the performance of this contract at the rates of wages contained in the wage rate determination.

DEPARTMENT OF JUSTICE CONTRACTOR RESIDENCY REQUIREMENT

For three of the five years immediately prior to submission of your offer/bid/quote, or prior to performance under a contract or commitment, individuals or contractor employees providing services to any Federal Bureau of Prisons facility must have:

1. legally resided in the United States (U.S.);

2. worked for the U.S. overseas in a Federal or military capacity; or

3. been a dependent of a Federal or military employee serving overseas.

By signing this contract or commitment document, or by commencing performance, the contractor agrees to this restriction.

INVESTIGATIVE PROCEDURES FOR CONTRACTORS, CONSULTANTS AND

VOLUNTEERS

The Bureau of Prisons (BOP) policies regarding investigative procedures for contractors and consultants are set forth in Program Statement (P.S.) 3000.02, Human Resource Management (HRM) Manual and P.S. 4100.03, Bureau of Prisons Acquisition Policy (BPAP). In particular, the HRM Manual requires detailed security procedures for all individual contractors including contractors performing pursuant to any purchase order or any purchase card transaction, for which the period of performance is equal to or in excess of 30 days. Additionally, the policy is applicable whenever a contractor is performing pursuant to more than one purchase order or more than one purchase card transaction, for which the periods of performance, when combined, are equal to or exceed 30 days. The requirements of the HRM Manual, Part 731.2 and BPAP Part 37, for implementing such procedures for individual contractors for periods of service exceeding 30 days include:

In addition to the above procedures, BPAP Part 37.103 states that Contracting Officers must ensure through the contracting process that each prospective individual contractor is advised that a urinalysis is required prior to contract award. Prior to award, the Contracting Officer shall also obtain from the Personnel Officer or the appropriate Cost Center Manager, written assurance that investigative procedures have been completed for contracts awarded to individuals. For contracts awarded to companies, this written assurance must be received prior to the contractor beginning performance. The HRM Manual, Part 731.2 states if the contractor is a company providing construction or maintenance services, all of the above procedures are required except for vouchering, urinalysis testing and law enforcement agency checks, however, the contractors employees must be closely supervised by institution staff.

STATEMENT OF WORK:

GENERAL INTENTION: It is the intent of this solicitation to result in a firm-fixed-price, indefinite delivery-indefinite quantity contract for Vegetable Transplant Services for the UNICOR Farm located in Lompoc, CA. The guaranteed minimum shall be $10,000.00. The period of performance shall be date of award through 36 months. The qualified vendor shall provide their firm-fixed-price quote under three separate scenarios:

SCENARIO 1 – FULLY OUTSOURCED VEGETABLE TRANSPLANT SERVICES

FPI is in need of a qualified vendor to grow broccoli plant from seed, transport the seedlings to the UNICOR Farm in Lompoc, CA and then transplant the seedlings on to the UNICOR Farm.

Seed will be provided by FPI to awarded vendor to use. Awarded vendor shall supply all other materials and labor necessary to the growing process. Broccoli plants are to be transplanted by awarded vendor at a plant population rate of 36,682 plants per acre with a possible adjustment for plant spacing during the winter months. This rate is good for 365 consecutive days, beginning from the first transplant date. Weekly plantings will begin at four (4) acres per week and can be expanded to a maximum of fourteen (14) acres per week, using the same rate.

SCENARIO 2 – VEGETABLE NURSERY AND DELIVERY SERVICES

FPI is in need of a qualified vendor to grow broccoli plants from seed and transport the seedlings to the UNICOR Farm in Lompoc, CA. FPI shall be responsible to transplant the seedlings on the UNICOR Farm in Lompoc. Seed will be provided by FPI to awarded vendor to use. Awarded vendor shall supply all other material and labor necessary to the growing process. Broccoli plants are to be transplanted at a plant population rate of 36,682 plants per acre with a possible adjustment for plant spacing during the winter months. FPI shall be responsible to transport the seedlings to the UNICOR Farm in Lompoc, CA, and to transplant the seedlings on the farm. Seed will be provided by FPI to awarded vendor to use. Awarded vendor shall supply all other material and labor necessary to the growing process. Broccoli plants are to be transplanted at a plant population rate of 36,682 plants per acre with a possible adjustment for plant spacing during the winter months. This rate is good for 365 consecutive days, beginning from the first transplant date. Weekly plantings will begin at four (4) acres per week and can be expanded to a maximum of fourteen (14) acres per week, using the same rate.

Although the awarded vendor shall provide nursery services under each scenario, at the discretion of FPI, the awarded vendor may need to either transport the seedlings to the UNCOR Farm, or transplant the seedlings to the UNICOR Farm, or perform both services. Thus, it is contemplated that the final award shall reflect pricing for such service individually and the qualified vendor should provide pricing accordingly.

Awarded vendor will sow orders to meet a weekly planting schedule, which can vary pursuant at the discretion of FPI. Further, the quantity of the orders shall be based upon an expected germination rate of 90%. For example, for a required plant population of 36,862 per acre, FPI Lompoc UNICOR Farm will provide seed at a rate of 40,758 seeds per acre:

Once actual germination rates are known, the over-sow percentage and quantity of seed sown per acre may be adjusted to a mutually agreed upon quantity. Any plants that are not transplanted in a given week will either be used in the following week (rolled) or discarded (dumped) based on the quality, age and condition of the plants. FPI Lompoc UNICOR Farm will only be invoiced for plants that get transplanted into their field. Invoices shall be submitted monthly, and reviewed for accuracy by the FPI Farm staff.

Transplants must be ready to plant according to attached planting schedule. Extra plants will be discarded at the discretion of FPI Lompoc UNICOR Farm based upon the quality and condition of the plants as well as the needed quantity.

In addition to the aforementioned contract guidelines, the following criteria must also be met:

• All Primus lab food management and safety guidelines must be followed;

• Must include 450 plugs (trays);

• Hours of operation must be set between Monday through Friday between the hours of

6:30am – 3:30pm (Holidays Excluded);

• Must notify an FPI Lompoc UNICOR Farm Staff Member of all Crew Members, Vehicles and/or Trucks PRIOR to arrival (at least 24 hours ahead of time) and park Vehicles or Trucks in an area designated by FPI staff:

• Proper notification of delivery, pick up, and/or cleaning of portable restroom times must be communicated and coordinated with an FPI Lompoc UNICOR Farm staff member.

The awarded contract may be modified to include additional types of vegetable seed, other than broccoli. All specifications for such seed and transplants shall be included in modification to award and issued upon mutual agreement between FPI and the awarded vendor.

GOVERNMENT FURNISHED PROPERTY

All approved vegetable seed will be provided to the successful offeror as government furnished property after award and the offeror will be required to acknowledge the receipt of the approved vegetable seed in writing. Any requested changes to the approved vegetable seed must be made in writing to the contracting officer at Karen.Hodge2@usdoj.gov. No changes may be made to the approved vegetable seed without prior written approval from the Government. THE

GOVERNMENT CAN REQUEST THESE APPROVED VEGETABLE SEEDS BE

RETURNED AT ANY TIME AND THE OFFEROR AGREES THEY ARE FURNISHED AS

GOVERNMENT PROPERTY.

Offeror agrees to package the approved vegetable seed for shipment in compliance with industry standards.

At a minimum the approved vegetable seed must be secured to prevent movement and damage during shipment.

UNICOR will pay for the shipment of the approved vegetable seed and the cost of shipping must be approved by the contracting officer prior to shipment.

It is UNICOR’s intent that the approved vegetable seed will remain with the successful offeror throughout the duration of the contract unless the contract is terminated. The vendor will be given written notice by the government for the return of the approved vegetable seed.

Since this is Government furnished property, the government will be financially responsible for the maintenance and any reasonable repair cost of the approved vegetable seed. The offeror is responsible for any damages caused to the approved vegetable seed by the offeror while in its possession. The offeror is to submit a written quote to the government for repair work prior to any work being performed. The contracting office r will provide written .authorization to the offeror to proceed with repairs if deemed necessary. UNICOR may elect to send its representative to the successful offerors facility to inspect the approved vegetable seed at any time.

Once the approved vegetable seeds have been provided to the successful offeror after award, they will have 10 business days from receipt of approved vegetable seed to provide a written disposition of the approved vegetable seed to include but not limited to:

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
