Amendment 0003 provides: (1) questions and answers to clarification questions from potential offerors, and (2) updates the RFP to include: the proposal due date is changed to November 16, 2012, Clauses B.5 Type of Contract, 52.217-9 Option to Extend the Term of the Contract, 52.217-8 Option to Extend Services, add FAR Clause 52.217-5 Evaluation of Options and delete clauses B.3 Cancellation Charges and 52.217-2 Cancellation Under Multi-year Contracts.

Accordingly, the solicitation is amended as follows:

Question 1: The solicitation includes a due date for proposals of 11:30 am on November 17, 2012. November 17 is a Saturday. Would the government like to revise this date?

Department Response: The proposal due date is corrected to read Friday, November 16, 2012, no later than 11:30 AM Eastern Time (ET).

Question 2: The solicitation is inconsistent in its designation of the Data Collection and Delivery task as cost reimbursable (page 11 of solicitation) or firm fixed price (Performance Work

Statement). NCES projects historically designate data collection as cost reimbursable due to the variety of unknowns such as schools that will be selected for the assessment, response rates, travel costs, and other factors affecting data collection. This variability seems to be recognized in the recruiting task, which is designated as being cost reimbursable. Should we assume that the data collection and delivery task is cost reimbursable as stated on page 11 of the solicitation?

Department Response: B.5 Type of Contract of the solicitation is corrected as follows:

Delete: B.5 Type of Contract

Replace with the following B.5 Type of Contract:

The Government contemplates award of a hybrid contract including both fixed price tasks and cost reimbursement tasks from this solicitation. Below is a break out of the anticipated firm fixed price and cost reimbursement tasks.

I.24 52.217-8 Option to Extend Services is updated as follows:

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised once, but the total extension of performance hereunder shall not exceed 60 months. The

Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

I.83 52.217-9 Option to Extend the Term of the Contract is updated as follows:

(a) The Government may extend the term of this contract by written notice to the Contractor within 60 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 120 months/10 years. (d) The Government envisions a need of an additional five years of the type of work covered by this contract. Pursuant to Public Law 107-279 the Government shall have the right to negotiate and award a follow-on contract up to five years without re-competition. This right shall expire 90 days after the expiration of the period of performance of this contract. (e) If the Government exercises this right, the contractor agrees to negotiate, in good faith and to include fair and reasonable prices in its proposal. (End of Clause)

L.9 Additional Instructions to Offerors is updated as follows:

The offeror shall provide budget data for the additional five year option in its proposal.
