About this file

This is a Direct Award Posting and Justification form from the West Virginia Purchasing Division for the Educational Broadcasting Agency (Department 0439). The agency is requesting a direct award to Frontier Communications for two dedicated internet access (DIA) fiber circuits to support television broadcast delivery, including lottery services, to multiple locations. One synchronous fiber circuit is required for the Martinsburg microwave tower site at 100 Mbps, and a second circuit is needed for the Beckley facility at 1 Gbps to provide redundant service protecting broadcast-over-IP solutions. The Martinsburg circuit serves as backup when microwave systems fail, while the Beckley circuit provides additional redundancy separate from the agency's current vendor, Segra. The circuits must be installed by September 1, 2025, and the service term is 60 months.

The total monthly recurring charge is $1,020.00 with a one-time non-recurring charge of $40.00, which includes IP address blocks for each location. The direct award is justified based on vendor availability constraints—the Martinsburg location is remote with limited vendor options, and the Beckley circuit must be fiber separate from the incumbent provider Segra, leaving Frontier as the only viable alternative vendor. Prospective competitors must meet specific requirements: provide synchronous fiber connections, use fiber independent of Segra or Frontier networks, incur no non-recurring build-out costs, and provide a minimum of 32 contiguous public IP addresses. The public notice period for vendor interest was established in accordance with West Virginia Code 5A-3-10c for delegated procurements between $5,000.01 and $50,000.
